    Guys wait till you see "real" bulletin and even if mirror to what has been placed to Mumbai Consulate, EB3 will forward perhaps slowly now but picking up. EB3-India with PD 2004 mid and before will not have to worry that much.

    Congratulations to all IV members for being able to apply for I-485. This is GREAT news. Please please apply for your I-485 at the earliest. It would be best if your application reaches USCIS in the week of 2nd July. Here is the link to July Visa Bulletin:

    The main issue with Dems winning is that they will use the newly gained power to furthur their cause for 2008 presidency, but bringing down teh republicans. If taht takes priority which I fear it, immigration reform may go down the drain, as they try to retract all legislations passed by Bush, like tax cuts for oil Comapnies etc. and only work on potraying Republicans in a bad light.

    First - EB2s stop replying posts that were written in frustration and you understand why, They will not affect and take away your GC. Since you are not frustrated you have to start first.

    Second - EB3s - Frustration will never bring you anything and you can not move PD faster. Instead capatialize the situation that EB2s are getting GC. How you have to think and focus.

    I can give my example. I made network of some who got GC and have some influence in recruiting. After working 9 years for a big Pharma and got layed off, My one buddy got GC long back in EB2 , helped me and received job through him though I have to drive 220miles everyday.

    Am I frustrated yes!! More than anybody else here but has to calm down and think positivily.

    Hope my post will help you to reduce some frustration.

    I can understand the frustration among Eb3s. Honestly I do not want to aggravate their feelings. My only objection was for someone to generalize all Eb2s as being dishonest.

    The H1B visa belongs, in effect, to the company that sponsors it. You cannot work for any other company on that visa other than sponsor. If this is a transfer, then, In a so-called "visa transfer" what actually happens is that the initial visa is cancelled in favor of another one issued for the new employer. What that means is OP's work with old employer is considered as "unauthorized work". Do not consider this as illegal presence, as his legal presence is controlled by a valid I-94.

    you never worked for X and has been working w/o break with #2 ... u said, I believe.

    Write to USCIS simple explanation and show a proof such as HR letter stating your presence on active payroll continusly for all the term and run it through attorney, if you have. Else put together logically framed chronologically ordered history. Attach W2's for the years and demonstrate un-broken timeline.

    If their is nothing to hid or falsify, ... don't worry about anything. Good news is your case is active. People here ( no offense to anyone) will split hairs trying to answer simple issue. Keep it simple and truthfull and nothing adverse will happen.
    I hope you assume this as a new H1B not a transfer or else your post is wrong.

    As long as you have had a valid h1b peition approved for employer 1 and employer 2 while you worked for them you are FINE.

    According to my lawyer there is nuthing like a h1b transfer. When someone decides to move to a new sponsor that new sponsor files for a h1b via the petition but nuthing gets transfered, they need to refer to old h1b just to prove thatyou are legal and have been maintaining legal status.

    in your case Employer X did so but you never joined that employer so you are fine. USCIS can get back to that emplyer if they have not cancelled your h1b as they are liable to pay you by law. Pay him? Correct, only if OP work for them :) Employee "no show" is not considered as employer problem, han he had to cancel the H1. !:)


    For real as you had an approved petition (latest but not the greatest) from Employer X but did not join them you are fine as long as you were still holding a valid petition with Emp # 2. You should respond back to RFE stating that you were maintaining stauts via emp#2 and were offered a job by EmpX which you never accepted. As a proof you should sen copies of pay stub for enitre period and w-2 + peition and visa copies.

    Once the H1 transfer application is approved, Employer 2 is not considered as sponsor but employer X. Hence work with Employer 2 is not authorized.
    Note H1 to L1, H4 to H1, L1 to H1 is completely different, it is change of status - H1 to H1 is not change of status, Correct, but its a change of sponsor and new sponsor is X.
    so there is no question that you recent h1 is valid (Employer X after transfer) and past is invalid (employer #2) . I cannot agree with you more on this., but this is opposition to your earlier suggestion (see in red). Get an attorney, Good weekend !:)

    Hi,
    My H1B 6 years will be finished in February. My I140/485 were filed in August and I will be laid off on December 31. What options do I have now?

    - My employer had filed my immigration papers at my current work location. They are willing to relocate me to different location but are not sure on the impact of change in address. Can I relocate with my current 140/485 filed for current address?

    - Can my H1 be extended based on approved labor? I can then move to new location with same employer on renewed H1B and start the entire process again?

    What are we supposed to do now?? we should make this an IV campaign issue. USCIS is not following the rules set by congress. AC-21 is the law and USCIS is not following the law and causing hassel to the legal immigrant community. The legal immigrant community should really do something about this.

    I will wait for Denial notice. My attorney might get it mid next week if USCIS send it today.

    I don't know if anyone has been through this situation before.... I want to know if they filed MTR and case got reopened?

    I got a RFE on my 485 on 11th April and I have responded to it. By next week it would be 60 days by which USCIS has to take some decision. What would be the status update as my PD is Aug 2006.

    Is it normal to get RFE while PD is not current?

    Gopi544 I was in the same boat, I also got RFE when my PD wasn't current and then got approval I think yours is also on the way.:)

    Hi all,
    This discussion is very valuble for people like me deciding between living in Canada as PR vs H1B USA .We all know that salaries in USA are slightly better than Canada .But now the exchange rate is almost equal.

    Salary:
    Can a person with family(2 kids) survive in Canada with CAD 50,000 / year salary in a place like Toronto.? I heard in Canada you pay 13 % tax on anything you buy .Does 50 % of your income goes in taxes ?

    HealthCare:
    Also is the government sponsored health care good compared to USA .I mean do you have any wait to see specialists.Is healthcare comparable to USA .

    Immigration:
    In USA anyone can get a Greencard regardless of their qualifications and it depends how early you enter the GC queue.But looks like in Canada they value your educations and other qualifications.Can IT professionals (non-managers) apply for Canada PR without a job or canadian education?

    Canadian Citizenship:
    Many people want to get Canadian citizenship and return to USA with TN Visa .In future ,could USA put restrictions on this .?

    Please share your thoughts .

    This is an interesting development. It will create a clear division among supporters of CIR. It is so enticing to say,"who cares about CIR if we have SKIL" from our perspective. Hopefully this is a sincere effort not just some political posturing.

    The bill mirrors a Senate Republican-sponsored bill and would more than double the number of temporary visas and permanent green cards available to skilled workers each year. The bill also would make it easier for U.S.-educated foreign nationals to stay here after graduation and work in their field of study.

    The measure is the first time Republican conservatives in the House have endorsed any immigration bill that didn’t deal solely with border enforcement. A Shadegg spokesman said some House members also favor passing a measure that makes more visas available to agriculture workers. He predicted that action could begin on both measures after Congress comes back from its summer recess — and after a long string of House immigration hearings has run its course.

    That still leaves out a guest-worker program and some plan for dealing with illegal immigrants already here, but would inch the House closer to a Senate immigration-overhaul bill.

    Judiciary Committee Chairman James Sensenbrenner (R., Wis.) has insisted he won’t permit any immigration bill to pass until border enforcement is tightened. If a measure that eases visa backlogs for highly skilled workers has to go through his committee, “that could be a problem,” says a Shadegg spokesman.

    It's a valid point from ur prospective, but let me give u the example if the shoe was on the other foot..
    I'm sure this is a simplistic generalization, but urs is too

    Thank you. You seem like a rational person who is balanced in arguments. I can give you real life examples too. Let me start with that. In 2005 I and my friend from a non-retrogressed country graduated with a masters, same degree same specialization.


    * In a few weeks, all the 20 in the retrogressed country find opportunities among dozens of giant offshoring firms that quickly send them on H1 or L1 projects, within months or may be a year they are settled in the US and at most in 2003 their greencard process is up and running


    Now THAT is over-generalization. You think all of us Indians and Chinese get jobs as soon as we graduate in giant offshoring cos? My friend you're stereotyping. It is wrong to assume that we get our jobs because of our nationality and not our skills.

    Anyway, continuing with my example. My friend and I both found jobs after a few months of struggle in small boutique consulting companies (run by Americans), mind you no offshoring. In fact my friend's sponsor is Indian, my sponsor is American!



    * The 20 equally qualified non-retrogressed however linger in their homeland for years and duke it out till the brightest 3 manage to find a rare opportunity that only comes every several years.. those 3 finally come to the US in 2005 and may be start their gc in 2006


    Very subjective. My own example, none of my fellow-graduates were in the plight.


    * Turns out (or actually it was known all along to people before they chose to came) that the US only gives 5 greencards per year and because they know qualified people exist in all countries and they don't want few countries to swallow the whole quota alone, they give 2/5 to non retrogressed and 3/5 to retrogressed.. only then do some people remember to cry not fair, well it wasn't fair to start with!

    I agree a universal 7% limit for any coutry regardless of its population and number of college graduates is stupid.. the percentages need to be adjusted. But to tell me that the 3 unretrogressed have to stand at the end of the line behind the equally qualified 20 retrogressed who came here faster (and chose to come here knowing their homeland is retrogressed) that is really fair.. yeah right!

    Yup. Standing your turn in line is fair. And that's what needs to change. EB visas are about skills and not nationality.

    You need to quit stereotyping and being unfair to us by saying we get jobs because of our nationalities. Brother, you don't get degrees or jobs because you're Indian or Chinese, but because you add value.
