No you can't. You must have filed separately. You could have amended your return to file jointly, but not the other way around.

So, I can do it that way (file separately first and get stimulus and then amend the return to file jointly after I get stimulus) only for tax year 2008?
(IRS website also says if u do so, you dont have to return the stimulus benefit - unfortunately this clause was added only on 04/14/2008!! according to IRS website).

i think it's not quite that simple.
there is no doubt that lack of numbers is a key key issue. but letting uscis off the hook when they have failed to process 269,000 Green Card numbers since 1994 is not kosher. that is >20% of the backlog right there.
my straightforward NIW application based on national interest service not exceptional ability (which may be more subjective) will take almost a year to process. wow....!

LAR (Last action Rule) will not applicable in this case. It is applicaple only in change of status ( like H1B to H4 or L1B to H1B). Not in H1B to H1B. If you continously maintained H1B status, you are OK, as long as the H1B approval is valid employer2. Employer 1 or Employer 100 can file H1B, even without your knowledge. Therfore, you dont worry. As you were authorized for employer 2 for that period and you worked for them in that period, you are OK. Exlain them in detail with the evidence of H1B approval for employer 2 and pay stubs. Any way, consult an attorney.
Trouble is only if this is a transfer. By the way LAR is applicable on status (L1,H1, H4 ect.). Work for Emp 2 is whether "authorized" by CIS or not, depending on New H1 vs. Transfer.

Suppose Company A filed for visa cancellation on 11th June, Monday. Please let me know if there would be any problem in filing for H1B transfer now as Company A has filed for cancellation before i file for H1B Transfer.
I have seen in other posts that you have about 2 weeks to get a new job who will file for transfer. But contact an attorney and if you cannot change job immediately then consider change of status to F1 or another status.

My Lawyer didn't file my I-485 until July 7, 2007. He never replied to my e-mails or my phone calls.
My whole experience with them appeared to be as if I know more than them. It appeared as if I had to educate them about the development.
Considered changing lawyers and also considered filing on my own. But finally thought to ahve atleast soem attorney whom i know(at least i know what can expect?).

H1B visa is meant to be for people with skills that are in shortage in the US. If any H4 feels that he/she should be able to work, he/she should get a H1B. I agree that it may be difficult for some H4s to find a sponsorer for H1B, because their skills are not in shortage in the US.
Some spouses may join their H1B counterparts in the US, with an expectation that they will eventually get the GC and will be able to work, no matter what their skill set is. This is a reasonable expectation. So, blame the retrogression.
I do not believe that H4s should ever be allowed to work. They just take away jobs of more skilled workers who are unable to get H1Bs and who are still in their home countries trying for one. Skill-less free riders!
Now, please don't bash me with counter arguments!! ;)
After making such a harsh statement as above,"I do not believe that H4s should ever be allowed to work", I wonder whether you have your spouse with you in the US. If yes, you are not compassionate about their situation.
The L2 visa people were able to get EAD, not only because their spouses had good influence, but also because they showed respect to their spouses , who compromised their career, to travel with them to the United States, while they were chasing the dream.
If you do not know the meaning of compromise, and mutual respect, there is no point in running a campaign like this for the welfare of immigrants.
How can you totally ignore the plights, of H4 people, and run a campaign like this for green card. I believe that it is pure selfishness if you do the same. I mean maybe you are not married, or may be you and your lucky spouse, may be the one who didnt have to fight for any H1B lottery while in H4 and to make the tough choice of being with your spouse or losing the career. If being lucky in your life is the reason of making such harsh comment, without even understanding others problem, then I just want to advice that luck is a very tricky thing, and may be you will also face issues in this foreign land for which you might not get any support.
Also, dnt just assume that just because you got your H1, you and your friends outside the US are smarter than the H4 people. Some of us also had an enviable career back home and which is respected through out the world, but made the compromise as we cared about the career of our spouses in the US.

I am an EB-3 I and I do agree with lots of Eb-2 folks over here. Eb-3 folks can contemplate of moving on and apply fresh labor/140 and port to Eb2.

Do you guys think its worthwhile to go back instead of trying waiting for the retrogression to end. From the looks of it, i doubt there is any chance of an immigration bill before the elections. if there is no bill then we will end up waiting for 8-10 years for the dates to be current.
if they remove the US masters from the quota, imagine the rush it will cause in the universities, effectively it will imply that you will get a green card after you study for 2 years in US. take a 20-40k loan and get a GC. There is no country quota for F1. i had friends who were rejected for F1 because they were 'potential immigrants' wonder how this theme will play out in future.
from this shore returning back seems to be an alternative worth considering...or maybe its just todays depression talking.

USCIS does not work for you or me but sure you can go and ask them for prefiling AOS but not to issue RFE for same job requirement condition and other haressing rfe. how can you say we cannot ask USCIS not to raise RFE for irrelevant stuff,I guess you are ok with all the RFE that are being issued by USCIS on h1 holders currently. Sure some of those rfe are valid ones but vast majority of them are to kick h1 out. Does USCIS or any other department issue rfe to GC holders when there is something "fishy" as you put it. Like I said as long as you work in the relevant field in which your labor got certified we can ask to be left alone. Its one thing to get an rfe for birth certificate, medical records and another thing if you are issued the sort of rfe that are being issued to h1. You and all the people who missed out on July fiasco obviously want to file AOS and get EAD at any cost (i understand and support that ) but what about us who have been here for 5 to 10 years and took us multiple years of wait to file AOS and get EAD. Without strengthening AC21\EAD and allowing everyone to file AOS is going to attract USCIS, grasley, sanders and all anti eb folks attention.
You have a great plan, come to US on H1 and within 6 months get EAD and you are free from H1b crackdown by jumping to EAD. I believe that I made a very good choice five years ago. Most of my chinese classmates during MBA study are still struggling for their GCs and get stuck in their career development because of GCs. They are quite regret that they did not come back to China back 5 years.
So what I want say is that, US is not a very good place to stay anymore. There are many golden opportunities in your own country! Many countries are becoming stronger and stronger. It's not 10 or 20 years ago. 10 or 20 years ago, US is the best place in the world to stay. But now, it's different. My friends in US make about $150k a year and cannot afford a luxury lifestyle. I make $100k a year and enjoy a very comfortable life in China. I built my own house in China, which is even better than my house in New Jersey before. I hired my own chauffeur, housekeeper, two nannies for my baby... I cannot afford these thing if I were still in US. How many americans can afford the same lifestyle as mine? I don't think there are many.
My point is, be open to opportunities in your own countries or other countries in the world other than US. You will be happy to leave US several years later when you look back. Besides, if more and more US-trained scientists and professionals come back to their own countries and help their countries to develop, maybe in another 10 or 20 years, no one would want GC anymore."

I filed my 485 in July 11th and have received the 485 receipts. There is a possibility that I might get laid off before Jan 11 (180 days). My H1 B expires Nov 2008.
Questions
1. Can I stay legally in US if I get laid off in Oct 07 ?
2. How can I proceed with my Green Card process ?

"Supporting the troops" is a no-brainer for a politician wanting to score political points. Most Americans could care less about immigrants or other citizens who are married to them. So there is no political urgency to solve that "problem." Although the media has reported that the exclusion of legal immigrants was "unintended," my sources say that the exclusion was intentional.
I had hoped to embarrass the government further by exposing the connection to a known "hate group," but the media has refused to report that part of the story. If I could get the media to expose the racist origins of this law, we might have some hope, but don't count on it.
The next phase is to focus on legal options.

I say it, others just do not say it. I have openly criticized Murthy and even Khanna in my old posts - but now I have my highest respect from them, Murthy cheered the crowd like anything and priased all the grassroots efforts.
If people cannot get motivated - it is their EGO and SELF PRIDE that stops them.
Once again - everyone feels it - I say it. I once openly critized immigration lawyers for their ways of handing things which is very obvious on Rajiv Khanna's forums, some people tried to attack me saying that I am not giving the right message but the other members said "We have it in our minds and you have openly expressed it"

I do undersatnd that these companies did not help you.. y don't u understand that we r not talking about u :) the statistics r these companies bring tens of thousands here every year from one country, yes on H1 or L1, not to sponsor them for greencards, but arriving here with a dual intent visa that allows for greencard application is not such a casual opportunity and that's what I'm telling you is rarely available to the equally qualified non-retrogressed folks. Once here, those thousands transfer to these small/mid size companies u mentioned and choose to stay and apply for greencards even though they know that with their huge numbers current rules will make their greencard journey longer..
Yes adjusting the quota percentages should be on the table, but if these companies hurt you by creating a longer line than the quota allows, , then you should take issue with these companies before you take it at your fellow non-retrogressed immigrants.
You're confusing the cause-and-effect. The country quota laws were put in MUCH earlier than any offshoring companies started doing H1s. It might in fact be the opposite, meaning that these companies are hiring qualified people who weren't getting GCs.
And besides these companies are all software cos that came up in the last 10 yrs, why should that stupid rule affect any person in a non-software field?
Yes we know that the current rules make the journey longer. The point is that it is unfair and that's why we should start trying to change it!
