Is it possible to extend H4 status after using EAD for a person whose I-485 pending in derivative status.
I read Cronin Memo reg. dual intent "Revision of March 14, 2000 Dual Intent Memorandum"
It seems to discuss reg. using AP to enter the country and maintaining H status.
Not sure if anyone here has done the extension of H4 after using EAD.

Center for Immigration Studies head Mark Krikorian blogs today on the subject: Temporary Protected Status (TPS) was invented precisely for cases like Haiti today when a natural disaster is so devastating that illegal immigrants from that country temporarily can't be deported. And there are already several members of Congress calling on the administration to grant TPS, and rightly so. He does criticize TPS, of course. And he suggests that if TPS is granted, it will encourage waves of boat people. Of course, with 100,000+ likely dead and mass starvation on the near term horizon, people will be taking to...

Hello,
I have just got my green card and I am filling out I-130 form for my older son who was 21 when I submitted my I-140.
My question goes to point 16, "Has your relative ever been under immigration proceedings?" as I am not sure what to check over not knowing the terms (Removal, Exclusion/Deportation, Rescission and Judicial Proceedings).
I am asking that as my son has been denied admission in the US last summer. He had an F-1 visa (through 2014) but changed schools, got another I-20, went to the US Embassy in my country, the Embassy denied him a new F-1 visa but they didn't stamp with "Cancelled" the F-1 visa in his passport so he thought the visa is still valid, returned to the US but in airport he was not admitted entrance and had to fly back to our country.
Sorry for my long explanation I just want to find out if what happened to him falls under one of the 4 Immigration proceedings under article 16 in I-130 form.
I want to get him here not have him banned for ever for not knowing correctly the terms.
Thanks in advance

Our friendly anti Jack has provided in the comments a couple of links to an intriguing story regarding Republican National Committee Chairman Michael Steele (currently embroiled in another scandal - this time involving strippers and GOP money - oy!). Steele has been one of the moderate voices in the GOP when it comes to immigration reform in the past and apparently he met with a pro-reform group called the Fair Immigration Reform Movement (FIRM). Accounts differ regarding whether Steele promised to work for immigration reform and, more specifically, help round up a second GOP Senator to sponsor the reform bill...

NO it's RIRO [Random In Random Out] process.
Lots of July 2nd filer are waiting.. So have faith and more wait..:)
I guess USCIS is sending Receipt Notes according to priority dates meaning with 2006-7 priority dates will get receipts later.
My 485 reached on 2nd july...No Update yet.
Can I ask any one get RN with priority date later than 2006?

Hi,
I am not sure if I am posting this question to the wrong thread, so sorry if that's so....
I was told by the lawyer that I needed I-140 approved in order to ask for 3 years instead of 1 year for my H1B extension. They filed the extension asking for 1 year, and a week later we have the I-140 approved. My current H1B expiration date is in June 2009.
Now,
1) is there a way to ask H1B extension for 3 years at this point?
2) If so, does that mean a new application, or an amendment/correction to the old one?
3) Is it worth the hassle to ask for 3 Year extension if it's possible?
Thanks in advance for sharing your knowledge/experience/thoughts...

The USCIS, on May 18, 2009, once again provided an update on the number of filings for H-1B petitions for the fiscal year 2010 program.
It announced that it has received approximately 45,500 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. It continues to accept petitions subject to the general cap.
I can report personally that the most recent H-1B regular cap I-129 petition that I filed was filed on May 11 and it was approved on May 15 premium processed.
Also, the USCIS announced that is has received approximately 20,000 petitions for aliens with advanced degrees, consistent with its prior update and it reconfirmed that it is still accepting advanced degree petitions because it assumes that not all the petitions it received are approvable.
Its beginning to look like the cap isnt going to be reached any time soon and, who knows, maybe not at all this fiscal year.

With all the uncertainity about dates moving backwards (unpredictable) is it better to go for AOS.
Is it true if you go for CP and dates move back..then your application is not approved untill dates become current?
Please advice

Hello All,
I am in my 10th year of H1B visa. (GC in process). Every other time I went to INDIA , I got my stamping in INDIA except in 2009 when I returned on Advanced Parole because of a lack of time. Now I need to go to INDIA again in July and I observed this condition for visa stamping at INDIAN consulates which is :
Have the same class of U.S. visa which is still valid or that has expired less than 12 months from the scheduled date of interview.
Wish to apply for the same visa class (e.g. had an H1 work visa, now applying again for an H1 work visa)
My question is whether my last entry to US on Advanced Parole will be interpreted as not having the same class of VISA. After I entered on AP , I did renew my H1 Visa and it is valid upto April'2011.
Thanks in advance

Hi,
My H1(second term) expires in December 2009. I was out of the US for more than a year and resumed my job in jun 09. My employer will be filing for H1 extension in October 09.
I have an approved I-140.
If my H1 extension gets rejected, will that affect my green card process ? If H1 extension gets rejected and if I switch to EAD, will the H1 rejection affect green card processing ?
Please Help.
Thanks.

Hello,
It seems that I made a mistake in my DS-160 and my H1B got stamped with an error in my middle name. I repeated my lastname as my middle name so my full name appears as: 1stName 1stLASTNAME 1stLASTNAME 2ndLastname
I have a Tourist Visa also stamped wich is OK. Also the data on my passport.
My I797 is OK and everything else is OK.
I am still in my home country. Should I be worried about it? Should I try change it here or in the US?
In any event, what's the correct procedure to change it?
Thanks in advance

Hello
I am working on H1 and my current H1 petition is valid until April 6th 2011.
My visa (stamp) expired in Nov 2009.
I have my new H1 extension petition approved from April 7th 2011- 2014( same employer).
I am going to India early Feb and will going to Hyd/Chennai for visa stamp.
In the visa appointment it is asking for my petition number: which one should I give current or the new extension one. I would like to have my H1 stamped until 2014 so that I can avoid additional trip to consulate.
Please help.
Thanks

Over more than the last 30 years, Ive advised countless foreign businesses and investors seeking to establish operations in the United States. Many thrived, but some, regrettably, failed to survive. Often, the founders inattentiveness to the requirements of U.S. immigration law has been a primary cause of rough beginnings or failures to launch. This blog post will offer best immigration practices and identify traps to avoid when a foreign firm or individual plans to start a business in America. 1. Respect the Law Its Not a Game. The U.S. is no doubt the world leader when it comes to...

Gurus,
To all those who have received the FP notices, are your I-485 dates current for Processing ? or you have received these notices after the lapsing of the earlier FP ??
I have done one FP initially when my Case was filed. Its been long since the validity of that FP has lapsed. Should i be expecting another FP notice??
Is fresh FP notice being sent to all those whose FP validity has expired? or are they doing that in a random manner ??
Please do reply.
Regards.

Online status says my applications were recd on Oct 2/ 2007.
My reciept notices show the right date in August.
Is there any need to worry or notify any one about this?
Please Advice.
Thank you.
Don't worry about the online status. Many people are receiving mismatched time between the receipt and online...
