Hi All,
if the dependent is planning to come back on AP and then start working on EAD, does it mean the primary applicant has to work on EAD or the primary applicant can still continue on H1.

My wife switched from H4 to F1 status and is near completion of her Masters degree.
She will be traveling to India soon and will be getting her F1 visa stamped.
Documents/advice from anyone who has done this recently will be appreciated.

My case:
H1B current until Jan 2010
Nationality: French
PERM approved last April
The lawyer is planning to file this week for i131-i765-i485 (target is wednesday)
Would it be ok for me to travel abroad next week, or are there some travel restrictions after we file the forms?
Do we need an official receipt from USCIS before I can leave the US, or before I came back from the US, or any other restrictions?
Would some of you know?

Hi ,
1.My wife works for part ime H1b. She has her H1B till Aug 2011. She would Like to apply for her GC. Can she apply for labor certification with part time job? She can get a full time job after she gets in to adjustment of status. She doesn't want full time job now as our kids are still small.
2.I have a fulltime H1B and Approved I-140 EB2. PD sept 2007, waiting for retrogression to file 485!!!! god know when that will happen.Can I apply for EB1 while my EB2 pending?

Specifically mentioned in this category were three presidential candidates, Sens. John McCain (18th), Hillary Clinton (12th) and Barack Obama (27th).
Sen. Elizabeth Dole, sadly, was not given points for sizzle -- or much else, for that matter. She ranked as the 95th most powerful senator. Yes, that is out of 100. Vying for the bottom rung was also Sen. George Voinovich, who despite serving since 1998 ranked 90th. And as if he hasn't already had a bad year (or two), Rep. William Jefferson came in dead last in the House, awarded negative "fizzle" points due to scandal. USCIS has specifically answered a very similar question in 2004. The answer is "A change of status take effect automatically on the effective date noted in the [approval notice], even if there is an intervening admission...."
Your H-1B status should therefore take effect automatically on 10/1/09, assuming it was approved as a change of status.

I am not sure what is so important in this to answer.
As long as thay had sent the finger prints to you, you should be OK. There is no particular pattern in which they send the EAD cards. So, no body can answer your question about when will you get the EAD. Just pray and watch. If it is more than 90 days since you have applied for your EAD, then you may contact your local office to expedite the process.

Hello Attorney,
I have 6 months left on my H1B-I797 to expire. My visa on the passport got expired in 2007. I am planning to go to Tijuana, Mexico for stamping. I work for a financial company for past 4 years. I have approved I140.
Can you please advise if i can get the visa stamped? I have to visit India in May and hence cannot wait until the my H1B extension is filed and approved (based on my approved I140).
I am confused and worried that the consular officer may say that you have less than 6 months of validity on I797 and may deny the visa.
Can any one please advise?

Hi, my friend have not receive her fingerprint, her husband filed for I-485 on june 2007. their PD is 2004-ROW. their case forwarded into TSC. do you think this is normal ? what is the possible solution for this issue ?

We filed a H4 to H1 Change of Status petition for my wife. The file was opened and processed by USCIS and a RFE was issued. Due to some family situation, we had to withdraw the H1 petition instead of replying to the RFE.
My question is: Is the security/anti-fraud fee ($1500) returned by USCIS in such cases. We applied through a big consulting company.
