USCIS has released figures from the first week of the H-1B season and filings for the 65,000 H-1B "regular" cap slots for the fiscal year that begins in October were just 13,500. That is less than one third of the 42,000+ received during the same period last year and only about one-tenth of the number filed two years ago. Only 5,600 masters cap applications were filed against the 20,000 cap in that category.

I have an H1B approval from USCIS, and I am trying to go to Canada for the initial visa stamping. But then i have a problem. I initially entered the country as a visitor, and married a citizen, but only after my I-94 had expired for about a week. (My petition is still pending. The company I am working for could not wait for my greencard, since its already been years since I started that process, so they went ahead and applied for the H1B visa for me). I heard that it is a problem to do the visa stamping in Canada if you have been out of status before. Is it advisable to go to Canada for the visa stamping?:confused:

Have anybody feeling the big difference between Texas and Nebraska service center processing? Texas is giving greencards and June filers most of them have got EAD and Advanced Paroles. Is immigrationvoice doing anything to escalate the situation.

1) Wrap up the backlog and introduce enough visas to make all categories EB2/EB3 current for everyone.
2) Eliminate this nonsense of H1 visa stamp. A person should be able to apply for visa while remaining in the US.

Can I get my stamping done in US consulate in Toronto.
Where (Link) to take an appointment for stamping.

Hello Everybody. I am new to IV. Recently I have filed my wife's I-485 (06/28) after my I-485 approval on 06/18. My lawyer said that he has filed it by using the "Follow to join" benefits. He is saying that he cannot guarantee that USCIS will accept the I-485 since my I-485 is already approved. He said that we just have to wait and see until the receipt notice is issued.

Is anybody else in similar situation? Also does any one know what kind of documentation and cover letter needs to be included for this kind of case? I have asked him if he has included the I-485 approval notice and he said "No".

You can extend status while living at US, but for re-entry after international travel (after November 26, 2009) you must get the visa stamped on your passport.

Last year I had a serious fire injury and was burned >60% . I was in the hospital for most of 2009 but back to work again. However, during this fire my both hands were badly burned and lost finger tips of both hands.

I have 485 pending and working on EAD. But not sure how this will impact my green card process ( if finger printing is required) or my reentry in US on Advance Parole. I would like to travel and visit India soon.

Any suggestions recommendations are highly appreciated.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200.
