I don't think uscis can do that. They can either accept applications or reject them. If they hold the applications for next 3 months, they would violate their long-term procedures and would fear a lawsuit because of that. They know that they are original documents in those applications that can be used once again...god knows when...

the law has not changed, no one can presume what will happen
it's just that we are the fools in this, spending thousands of dollars without any choice in the matter, and then in one sweep all of it will be laid waste and we will be starting again...
what's more, for the indians among us, with the merit system, when with 90 points on board you will have no assurance of ever getting a green card.

Its not a merit system, its a disguised diversity visa in the name of skills/merit. What kind of merit system will not have qualifying points? Its a shame that Sen Kennedy's website gave examples of how people ranging from 50-89 points can get GC's. Just call it diversity visa. Its a lie of massive proportions. When is Sen Kennedy up for election?

Consider my case:
Myself: MS In Electrical Engineering - Been on a H1-B sponsored job with Fortune 100 companies for the last 6 years.
Spouse: MD Medicine - Initially on H4 for 2 years, now on a H1-B sponsored residency with a prominent healthcare institution.
I fully agree, H4s should prove their worth, and that is why I never ever let the feeling settle in my spouse's mind, that, that GC was going to just drop from the sky one day for her...
In short, both of us have proved their worth and are on H1s.
Here's where the unfairness of the H4 system kicks in for us. The time spent on the H4 is counted towards the initial 6 year period. By the time she would be done with her residency, she would have exhausted most of that 6 year time. LC cannot be filed for resident doctors, while they are residents.
Result: When she becomes a doctor, her time has run out - technically she needs to be out of USA for 1 year, before considering a re-entry (unfair by all means).
Only solution to this problem:
1. Either the laws change to decouple H4 time with H1 (which I think, is the biggest unfairness of the H4 visa, especially due to the retrogression wait times)
2. I get to file I-485, which I currently cannot because of retrogression. I have an approved LC & I-140 with a PD of early 06. If retrogression gets worse, who knows, even EB2 could retorgress to more than 3 years...

Really an interesting issue to talk about. I came to this site via google search. I am in the same boat. I am living in country for 14 years (F1 and now H1) with SSN. My wife never worked here; so she has H4. We have a daughter born here with SSN. We could not get this "stimulus rebate" because we filed "married filing jointly". I understand from IRS site that if you filed "married filing separately" you would get the benefit and you can later on amend your filing as "married filing jointly" (04/14/08). This may be beneficial if you "itemize" your deductions. You will still qualify for excemptions. But, if you do not itemize your deductions, your standard deduction will be halved if you file "married filing separately".
We filed married filing joingly and received our tax returns and no stimulus rebate. Can we re-file our tax return by filing separately this year (i.e. extension/amendment within 3 months?) Has anyone done this? Please let me know.

Majority Leader Harry Reid (D-NV) has scheduled a procedural vote on a motion to proceed with the Senate immigration reform bill (S. 1639) for Tuesday, June 26, 2007. If the motion passes with 60 or more votes, senators will begin debate on a negotiated list of 24 amendments, split evenly between the two parties.
Debate and votes on the amendments will continue until the morning of Thursday, June 28, at which point the bill will be put to a second procedural vote to limit debate. You have a great plan, come to US on H1 and within 6 months get EAD and you are free from H1b crackdown by jumping to EAD. You think USCIS, Grasley, sanders, and anti eb folks are a bunch of idiots, they will send you and me packing with the same rfe they are hitting h1 folks with if everybody gets to pre file AOS and get EAD. that is why you need to strengthen ac21 by removing same\semilar job condition and other potential h1 like rfe's, otherwise you will drag us down along with you and turn ead into h1.

mine is fragomen . they are pretty good...and have been working 24 by 7 in shifts to prepare forms. they are very responsive and very good people to deal with. surely recommend them.

Yes, I used to say like this five years back when I had time and age in my hand. I assume you are in early or mid 20's. I will put it differently for you.
Assume there is a big pond which starts from 1 feet and gradually increases up to 100 feet. People with one year work experience steps 0.5 feet. There are life jackets(GC) floating around the pool and whoever is lucky is picking it up. There are guys like me who are already in 5th-6th feet deep without finding the lifejacket, but we are sure if we go further, may be 3-4 feet more we WILL find it. There are guys who are lucky to find a life jacket at 1,2,3 feet also and happily float to the shore passing us. The fifth feet guy is practically seeing how the 6th and 7th feet guys are struggling. May be they are seeing some one in 8 feet to 10 feet. Now a big Tsunami (retrogression) comes and drags all the jackets 20 feet down further. These guys are dejected and some of these guys even pull their spouse/kids in one hand when they float/swim.
Dont forget, it takes one year to step 0.5 feet. Every year the pond management drops a fixed number of jackets. These guys keeps their hope alive based on the above fact. But these guys are seeing some kids passing in motorboat(LC Substitution) paying that guy 10K and getting a life jacket. Hmm pain, but even if I had a chance I would have also done it.
Now comes your saying. When the deepest s...t guys talks about their fate down the line and how to take their family safe ashore, a guy at 0.5/1 feet shouts saying "Dont give up, it is like deciding to take a sanyas because you are tired of dealing with social issues".
If you are in 5+ feet, I take your statment. Otherwise, you will not understand what I am trying to say until you reach 5+ feet without finding a life jacket and also pulling your family in one hand and seeing your seniors struggling more in 8+ feet. :)
NOTE: BTW, no offense. I thought to express what I am saying in different way. I understand what you meant. Cheers.
I am in my late 20's and am going to finish my 7th year next month...you decide how many feet of water I am in..:rolleyes: Meanwhile I totally understand your argument that the situation is the most frustrating for people who have been here the longest. I'd say sharpen you swimming skills and then it wouldn't matter how deep the water is or how tall you are....I's say stick with it and endure hardship if you value the end result (GC ofcourse). Even if you decide to go back...whatever your age/experience be...never forget its never too late..Gandhi was 46 years old when he returned to India from SA after spending 22 years there..Still wasn't too late for him to start a revolution now... or was it ?:)

Assuming no relief for immigration system as a whole, EB3 India will move forward substantially only during last quarter of the FY.
Rest of the times, it will be in 2001 or 1999 or even pre-immigration years. You never know.
The least preferred category among EB (taking the country tab in to account) is EB3 - India.

We need 15 more senators to switch to NO for this to fail (not just 5). There will not be another cloture. This cloture gives 30 hours of time to debate those 24 amendments. Then there will be a final vote for the bill with 50+ votes passing the bill. Remenber Dick Cheney, the tie breaker. So we ought to have 51 NO votes.
