    some of you asked about repercussions of this sudden forward movement. i am not a lawyer or anything but I think the processing time for employment based 485 in Nebraska Center will move back from Aug 13, 2006 (
    https://egov.uscis.gov/cris/jsps/Processtimes.jsp?SeviceCenter=NSC
    ).

    I dunno... may be by a year I guess (again total speculation - I am not a lawyer or an USCIS expert).

    also according to (http://www..com/usa-immigration-trackers/i485-graph) current processing times by recent approval dates seem to be between 250 to 350 days range (disclaimer: there are other ways to analyze this).

    While we are at discussing participation, a question I heard at DC comes to my mind. A member ( anil_sap?) asked another Texan member ( forgot name) - 'What takes you to become an Active member?'. To which my friend answered - 'Isn't he active alredy. He is here'.

    That made me think - is being active a nebulous concept. Who's is the real active member of IV? The Core and near-core that strategize, plan , co-ordinate and conduct the business? The guys subscribed to monthly payment but missed DC? Guys who were at DC but not monthly contributors? Guys who were there all 4 days? Guys who visited for a day? "Lunch-Break" agitators? Who is 'active' among these will depend on whom you ask!

    The following portion is in humor. Don't take it in bad spirit.

    I did a self-evaluation, and guess-what, I realized I was a different breed. A 'Know-Nothing' IV member!

    Being a IV member

    1) Do I know why was such a mass mobilization done on that particular day? Is it because there was a push for STRIVE act as speculated in the forums here? Or is it SKIL we are pushing?

    Ans - I KNOW NOTHING

    2) What is the criteria for getting selected for Lawmaker meetings? Why weren't some selected after following the USCIS-inspired process? ( inspired by Marks skit)

    Step 1 : Submit Labor petition E-IV-LOBBYDAY ( twice)
    Step 2 : Verification by Labor department (or is it Name check)
    Step 3 : Receipt Notice ( Talking Points)
    Step 4 : Waiting...
    Step 5 : Followup with RO (Rally Officer). You are still under Processing Time
    Step 6 : Waiting...
    Step 7 : More followup..
    Step 8 : Retrogression due to insufficient (visa) numbers

    Ans - I KNOW NOTHING

    3) Didn't some members from my state attend Lawmakers meetings? What was the result? Where they positive or negative about our cause? What should we do to followup with them?

    Ans - I KNOW NOTHING


    4) What does it takes to become an 'Active' member as defined by Anil? What will take for IV to trust a member enough to let him know of the purported plan for World-Domination? Or should we just remain content gossiping (with near-core members) and making our own guesses?

    Ans - I KNOW NOTHING

    5) Does my State chapter even exist as of today? Or is it an IV version of Flying Sphaggeti Monster, that we should worship without questioning?

    Ans - I KNOW NOTHING

    With so many 'KNOW NOTHINGS' to my credit, I feel like the member of a secret American political party in the time of the Whigs.


    Hey, You are one of the most sensible forum members I have come across. Keep up the good work and keep the posts coming. I was there at the rally and I agree 110% with you on everything you said above.

    I missed it, not aware of it, not sure why. I am glad to see this chapter grow. There was a time where we were searching for folks with torchlights. Thanks to Chintu, walking_dude, cagedcactus, bestin and all others who are now making this happen.

    I have a very close friend in Michigan, and asked him to join, but he talks about all hardships, about his HR manager, about his company, about his lawyer, about everything except IV stuff. I am sure there are many more people here doing the same thing. We have to motivate folks to come forward. We cannot afford to have people who are inactive.

    Good luck to you all, try to merge folks from nearby states if they are still not organized until they get organized.



    I will email you and other leaders to keep everyone informed about the activities here. Your guidance will be the fuel for Michigan Machine.
    Walking_dude, and others are also fired up and ready to go. Let me know if I can talk to your friend in Michigan, and request him to join us and come to the meeting.

    I must say that this is a great great effort. Both, the flower campaign and the rally. Nothing like this has been done before by wanna-be immigrants. We are hardworking, law abiding, well educated people. But until now, the general opinion was that we are at the mercy of the American immigration system. I was especially so frustrated when some of my friends thought that there was nothing wrong in what the USCIS did. Their response was simply "what can we do? let's just re-apply when the dates become current again". Historically, Indians (at least, from my experience) have been hesitant to protest against the wrongdoings of their rulers. This is seen even today, when we fear to raise our voice when our bosses or managers at work exploit us, or our advisers/professors exploit us, or if the USCIS changes rules in the middle of the game. In India too, the general opinion is "Nothing is going to change, let's not get into trouble". This rally has shown that things are changing. We all should wake up, and fight for our rights! I could not attend the rally as I am based in Michigan, but I thank all of you who protested for me and my family. I will do my best to support this effort in whatever way I can.

    I just thought of starting this thread for people who did not attend. Please explain in one or two sentences why you did not attend. Whether it was a personal reason, whether u were scared, didn't care, forgot, didn't know! etc.

    My reason:
    I really wanted a green card, but because India is growing so fast, I really don't think I want it so badly anymore. So, I did not have the motivation to go ...



    I am honestly curious. What changed in two months? You were desperate then, and you are not now?

    the past repub judicial cmtee chairman- both are very
    influential senators, not push overs.

    2. Senator from Washington has heard earful from the
    tech lobby.

    3. Our buddy Sen Cornyn is also a sponsor.

    4.It restores provisions for EB-1, outstanding professors, etc.
    NO SENATOR WILL WANT HIS/HER NAME ON THERE TO GUT THIS
    AMENDMENT ENTIRELY. AT THE MOST THEY MAY ONLY TRY TO DILUTE
    some provisions.


    Proposed Amendments to the Senate Bill

    Late last week, Senators Maria Cantwell (D-WA), John Cornyn (R-TX), Patrick Leahy (D-VT) and Orrin Hatch (R-UT) announced an amendment to the Senate bill that would make important changes to several of the employment-related provisions of the Senate bill. With respect to immigrant visas, the amendment would restructure the proposed merit-based program to add several of the features of the current employment-based system. The amendment would add an employer sponsorship component, and would create programs equivalent to the first, second and third employment-based preference categories for foreign nationals of extraordinary ability, outstanding professors and researchers, multinational executives and managers, advanced degree professionals, foreign nationals of exceptional ability, and professional workers (though the amendment would not provide for an equivalent to the current "other worker" subcategory). The amendment would also restore the labor certification requirement for the second and third employment-based preference categories, but would not provide for a national interest waiver of the requirement.

    In addition, the amendment proposes an additional 140,000 immigrant visa numbers for employer-sponsored merit immigrants, and would create a quota exemption for certain highly skilled immigrants who have at least three years of U.S. work experience.


    Regarding the H-1B program, the amendment would eliminate the 20,000 ceiling on cap exemptions for foreign nationals holding advanced degrees from U.S. universities and create a new exemption for foreign nationals holding foreign advanced degrees in the sciences, technology, engineering or mathematics.

    The amendment would also dispense with the Senate bill's expansion of the recruitment and non-displacement attestation requirement to all H-1B employers. Durbin& Grassley will not let this go that easily. At least some of the restrictions will be kept.

    Nothing succeeds without leadership and proper plans. If we go by the current rule - every one is a leader - we will learn soon 'Too many Cooks spoiled the broth'. If each person steering the boat paddles in a different direction, boat will go in circles.

    Focus is the most important factor in success. Right now, I'm focussed on what's getting posted here, as I don't have anything else to focus on till I hear the next secret broadcast , which I never get.

    Sales/Marketing is severely lacked in promoting State chapters. IV website does provide good info on filing 485, other forms, suggestions etc. What's the incentive in becoming a State chapter member? What are the costs vs. benefits? Unless people find benefits they'll not volunteer. It's hard to sell only 'action items'. Baits such as Free legal help, help filling Immigration forms (by experienced members) etc. may motivate people and make them sympathetic to our cause.

    If we stick to 'Don't ask what we can do for you, ask what you can do for us', we won't go far with it.

    The answer is we all will have to bell the cat...and it will take more than a few attempts to do that.

    IMHO, we should focus on what we can do rather than focusing on what some people could have done or what some one did to dampen the last attempt.

    People will always find time for what is important to them; all we can do is try to make it more convenient and keep giving then enough opportunities.

    We should have some sales/marketing people on this forum; they could have told us about how long it takes to convert a prospect to a customer.

    Have faith my friend...

    Folks,
    Please Ignore people who are obviously here to create confusion and to discourage and bring down the general morale. It causes a drain on the energy of the *Volunteer* Core Members. We should never lose sight of the fact that this is the one and only Forum that has our goals as the Priority and it is the *Volunteer* Core Members who have taken the initiative to try to get something done. The very fact that we have this Forum and that we have a coordinated effort to try to get some thing done to address our issue is worth the money that I have contributed and will continue to contribute.
    What will I do with a few extra 100's when I have no security?
    Folks please understand and support the effort. Be Positive and keep the energy effort and drive UP.

    It wasn't Ron's mere prediction but based on his discussion with Charles Oppenheim.


    Why do we still believe in Ron Gotcher's predictions ?
    He came up with a prediction in the past that EB3s will see a significant forward movement towards June-July or at least before this FY.

    Now he says there won't be any significant movement even in the next FY.

    Congratulations to everyone whose dates have become current. To all gurus. I wanted to know as to how does it work when it comes to procesing I - 485, what dates are important is it the filing date, or the Priority date? If two people file at same time with different priority dates who gets priority, one with earlier priority date or one with earlier reciept notice date or will the cases be treated at same level.

    If some one has applied for labor substitution for a better PD and I-140 a week back and wants to now file I-485 without the I-140 reciept. I guess the advise was that one can go for it. The question now is as the I-140 was filed a couple of days back does he need to provide the employment letter which in this substitution case is difficult unless the new substitution employer is willing to give. In such scenario can one file I-485 with out the employment letter.

    One of the required documents for PIO card is (apostilled copy of the US passport holder)
    just wondering what did you do to get the documents apostilled ?
    I tried looking for an answer, looks like it is a long procedure and you have to get it certified by the US dept of state ???
    So I applied for a 10year visa for my daughter and they issued in 8 days from san francisco.

    cshen , i think ur q got answered in your own thread i believe , anyways its for LPR - Legal Permanent Resident not for EB based.
