I am applying for H4 visa after my recent marriage with an H1B visa holder in USA. I am currently filling out the online DS160 form but stuck at the following stage: "travel information"
In the purpose of trip to USA question: the given options are business, travel or student visas, so i selected the option: "other". On selecting this, the form loads a list of further options in order to SPECIFY: the H4 option (dependent of H1B holder) is not given in this list. The nearest applicable option is "temporary employee H1, H2". When I choose this one, then at a much later stage in the application, in the section titled "temporary work visa information" the form starts to ask information on my supposed employer etc, which is clearly UN-applicable in my case, as I am NOT applying for an H1 or H2 visa. Kindly help me out, on how to proceed with DS160 in such a situation. Waiting for reply with anticipatory thanks. Sadatj.

Does anyone know if EAD renewal requires an employment at the time of renewal? My I140 have been approved and I485 pending for long time under EB2-NIW. Also, do I loose legal status to stay in USA if I lost employment while my I485 pending. Again, my GC application is not company sponsored, it was all by myself. Do I stay in right status even I become unemployed while my I485 pending. My I485 will be pending for few more years due to retrogession. So I am wondering if I can stay as unemployed for a period of time while my AOS pending.
Also, do I need to have an employment while re-entering using AP? I recently used my EP to re-enter but no question was asked about employment. I am thinking if I can use AP for re-entry if I travel outside while I am unemployed. I have to think about all this options as chaotic situation is going on the company and layoff might be inevitable.

My wife currently is on an H1-B visa and she also has EAD/AP based on my I-485 filing. Due to personal reasons she plans to quit her job soon (next 2-3 weeks or so). What will be her status? Should we be filing COS to H-4? Can we get a RFE for proof of her employment when I-485 is processed?

Will there be any updates on 485 LUDs when USCIS works on I-140?
I have submitted approved EB3 I140 and 485 on Aug 2nd 2007. I submitted EB2 I140 for approval on Dec 11 2007. There haven't been many LUDs on any of these files except when applied for AP and EAD. Now on Apr 7th 2009 I see new LUDs on EB2 I140 and 485(for both wife and me). There is nothing after that. I am not able to make out anything of it. Any comments, suggestions or opinions are appreciated. Thx

I am fortunate enough to have a pretty good arts and sports immigration practice. I've met a lot of really talented people from both fields over the years. I can't say I remember a family that has had members who have achieved as much as the Kleiza family, originally from Lithuania. Mother Kristina and afther Egidijus are two very successful painters. Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

Dear All,
I have a question regarding the H1b visa quotas.
The USCIS website stated on April 20th that they are still accepting applications as the H1 quota of 65000+ 20000(Masters) was not full.
Does anyone have any information about the latest news in this regard?
Has the cap been met or are they still accepting applications?

Hello everyone ! 13 years ago i was charge with Lanercy-theft wich it was a 2nd deg misdemeanor and possesion of cannabis under 20 grams 1st deg misdemeanor i plead guilty and served 3 days in county jail (Florida) , now i'm 32 married to an American citizen and getting ready to adjust my status , i just want to know how hard it"s going to be this whole process , i dont want to be dinied or deported , thanks for any answers.

Dear Sir/Madam,
I am planning to move back to India after I get the green card, possibly in the next 2-3 years. I really want the green card for my son (15 years old) who is very keen to come back to the US. If I take him to India to do his undergrad degree in India, will he be able to maintain his green card even if I am not present in US. I can give my brother's address (who lives in Chicago and is a green card holder) as my son's home in US. Will Rentry permit every 2 years for my son work? Or should I wait untill citizenship which seems to be too far considering my PD is nov 2007 EB2. Please advise.
