Guys -
I have an approved I-140 in the EB 2 category and I'm changing my employer next month. However, my current lawyer emailed me this morning saying that you can transfer your PD, but not in the same category (EB2). In other words, to keep my PD, I will have to apply through EB1 or EB3 with my new employer. I had not heard of this before and was wondering if this is a true statement. Has anyone successfully transfered their PD within the same category? Thanks.

USCIS used to have a lot of difficulty raising fees and would only get increases approved every few years. They now raise their fees frequently and have just announced their intentions to do so again. In the past, they blamed poor service on the lack of resources and promised - many times - that more money would translate in to better results. I once supported this view. But no longer. AP not yet received. But EADs have been received for me and my husband (primary applicant). However, my daughter is yet to receive her EAD. Anybody with a similar case? I tried calling IO in USCIS but they say that it may come any time within 90 days of the notice date (not the receipt date!):mad:

I am currently on L1 visa and want to apply for H1 through a small-time consulting company. However, I will decide on joining the new company only after I get the H1 visa.
* Is it get H1 visa and not join the company that has filed for my H1?
* Can I legally continue with my current company even after I get my H1?
* Can I join a third company instead of joining the company that has filed for my H1?
Can people share their experiences?

Hi,
I'm in the process of going through the naturalization process having filed the N-400 form.
However, I have a change of plans and would like to 'abandon' my naturalization application.
Would this affect any of my future applications? be it a future naturalization application or petition for a relative the green card.
Thanks for any advice as I can't seem to get a definite answer.

my wife is on her OPT and I am on my F1, her employer just filed for her H1b and my H4 I539 same time this week. (non profit university). So my question is do i need to go back to school next month to continue my education? or as long as the I539 is filed, i am under legal status? right now I have moved from Nebraska where we had our education to New york with my wife. if I have to go to school even when the I 539 is pending, can i just go transfer my status from the community college I am studying at in Nebraska to any community college that offers I-20 in New york? how can i report the change of school to USCIS after transfering? thanks!

In Mid 2007, 7th year of H-1B transfer & extension was filed, and was no problem as I had an approved ETA-750 with ex-employer, but it was expired soon as the sponsor�s (ex-employer) company was closed at the end of 2007.
The 7th year approval period was 12/11/2007 ~ 12/10/2008 with the current employer.
I filed another labor certification (ETA-9089) on 10/23/2007 which was sponsored by my current employer, and it has not been approved yet.
Using this ETA-9089 pending more than 365 days, I filed an I-129 extension for 8th year of H1B last November 2008, but INS sent "Request For additional Evidence Sent" letter which was saying to be provided �An evidence of pending / being processed for more than 365 days of labor certification or I-140 prior to 6 year expired of H-1B�. we just realized that a memo was posted regarding this on 05/30/2008.
As I don�t have this evidence... Please advise or recommend me...

My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.
I am planning to go to Ottawa now for a stamp that expires in Sept 08.

Visa stamp doesnt define your legal status or your stay period ,it is the latest I 94 . Visa stamp is only required when u travel outside the country.

I was recently on H1B and renewal/extension was denied. So I left promptly to go back to Canada to establish residence there and start working. Now I need to return to the USA to retrieve some personal belongings, wrap up my residence and bring a car back etc...
My question is, when I enter the USA for the first time after being denied H1B will I have a hard time and will they be reluctant for some reason to permit me to enter as a visitor? I can't see why they would but who knows???
My family is still in the US and I need to help to get them prepared to come back

My EB3 RIR is filed on Feb 2005. Waiting for LC to clear. Also H1B expires on Jun 2007. Waiting for H1B extension for another 1 year.
I would like to change my job once I get my H1B extension.
1) Can I change my Job during my one year H1B extension when my LC is not cleared?
2) Can I use my current PD (Feb 2005) when my new Company process LC again through EB2 PERM?
3) From the new company, once I get LC through EB2 PERM, can I apply H1B extension for 3 years?
Please advice. Waiting for you reply.

My wife is right now on H4 and having her EAD which will be expiring in another 2 months. She is not planning to work. Currently I am woking on H1B, soon I will be joing another employer on EAD. My question is it necessry for my wife to renew EAD even if she is not planning to use it. Once I swith on EAD what need to be done for my wife.
