It does make sense that the overflow numbers are given to higher preference categories in single state oversubscribed countries. When you think about it, will that not be the most beneficial to United States? Who would you prefer .... and Unskilled professional from a ROW category or a skilled worker from an Oversubscribed country. I would gather it would make more sense to give the opportunity to the higher skilled since the benefit to US will be higher
The more I read this form, the more I become disgruntled with this community! To say that someone from a lower class of visa and not from an "Oversubscribed country" (and I am assuming you mean India) is less skilled and less deserving than someone from a higher class and oversubscribed country is ludicrous to say the least. Each and everyone of us (and I mean "legal immigrants") have our own skill sets and contribute equally to the American society. As long as we are competent at what we do, then we are all SKILLED in our own way. The only real defining difference among the visa classes is the level of education not skill. To suggest one is better based on education alone is arrogance and nothing else!
The U.S. immigration system is not without its flaws and despite the delays and frustrations, it is FAIR! The per country limit is to ensure that citizens of ALL nations have an equal opportunity to immigrate to the U.S. and not just a select few. The only thing that I have found unfair as far as immigration in this country is concerned is the politicians' focused efforts to do something for the "illegal" immigrants at the expense of the "legal" immigrants.
We are all in this together and the insults and innuendos that dominate this forum divide us so let's stop them and focus on the real issues!

If your statement has been endorsed by the core that they want a million number then forget about this effort.I am feeling sad that i was part of this effort.I am not going to be part anymore unless i see some direct addressals from core to do it hence forth.I wish your million signature drive doesnt drive away many more like me.

Be pragmatic. How can you ask CIS NOT to raise RFE's for EAD extensions? If they find some thing fishy they would definitely dig the issue. Remember, CIS is not working for you or for me. I cannot stop laughing!
One more thing which I do not understand is how prefiling of AOS is related to Remove\dilute same similar job requirement? If you feel there is so much of importance for your SO COMPLEX CUSTOMIZED REQUIREMENT then why dont you start a new action item and gather people?

It takes 6 months to get Perm approval, with pre filing AOS everyone can get EAD in 6 months, anti eb folks and USCIS know that people will be jumping to EAD to escape H1 crackdown, what do you think they will do, they will add amendments and Bills to put restrictions on hiring EAD just like they put restrictions on hiring H1b. We cannot make EAD into another H1b like hell.

Doesn't it sound rude... they celebrate, feast and we fast. If we admire this country for giving us so much we should also show our support and adopt the culture and celebrate with them to show we are tax paying Americans who enjoy in American way.

i too worry that for a simple issues such as visa recapture the media (dobbs) and the zelots (num usa etc.) create such a stink wonder if any CIR related reform will ever pass. We are tiny spec in immigration reform and will keep suffering because of the larger concerns. My congressman always talks about supporting legals and skilled immigrant, but when we asked him to co sponsor this bill, his staff kept waffling.
You said you dont want to get into the discussion on who is better and yet by explicitly mentioning who you think is better, it seems discussion is started :D Being a Friday evening - work slow and I cant help but jump in :)
American presidential politics are highly media driven. When I came to this country and started following politics closely (12+ years ago), initially I was fascinated by all the discussions and transparent process etc. But over the years got convinced that its all a facade - election process here is as much flawed as in a "third world" country. Election 2000 is the biggest proof. Even worse, here people are easily swayed by non-issues. Media creates hype and media creates perceptions about a candidate, real issues and concerns takes back seat most of the times. Just see now - for last couple weeks everyone is talking about a VP candidate - the power of a VP is limited but yet everyone is talking about her and almost forgot the presidential candidate of the same party. The republican favoring press wants to project her as the next savior (which unfortunately seems to be working) and whip up their cadre. The democratic favoring press wants to project her apparent inexperience etc. We may soon see who is going to win in their "spin". In general republicans are pretty good in spin stories and project an apparently dumb candidate as someone with "whom you can have a beer with" and get him elected; now they might even succeed in projecting a 30+ year senator who backs current administration as an agent of change !!?!!! and people might even fall for that argument. Of course there are spin stories on the other side too.
Anyways, whoever wins this time - I think our situation wont change much and might even get worse. As the economy get worse - it would be very difficult to get any new bill favoring us (note I am talking about EB green cards not H1B). There is already a good effort by likes of numbersusa and programmers guild to project HR5882 as if it will kills jobs. As we know HR5882 is only for recapturing unused greencards the beneficiaries of which are mostly in this country already. It should have been a completely non-controversial bill - if we can see the resistance its facing we can imagine about any other bill that propose increase of GC numbers or something such. So prospects for anything better happening is very poor irrespective of who the next president is - that's my reading on this.

When M.K.Gandhi held his first rally against the British rulers(nothing personal here Franklin and Mark ), it did not result in immediate freedom, but was it worthless ?
May be we need to be more sensational like Gandhi to cause the desired impact. Gandhi burned the SA ID cards during the first rally. May be we should have burned our H-1Bs...:-) But I guess this is the extreme we can go to considering the vested interests we have in staying in this country. I believe this will be a slow and long struggle!

I think that going back to your home country ONLY because you feel overwhelmed by the delays in GC processing/retrogerssion (assuming you are quite content in your job and standard of living) is not a good idea. Especially true in the event that you and your family experience difficulties in adjusting professionally and socially after returning back. Chances are you might soon get a feeling of having taken a wrong decision in the heat of the moment, especially if the guys who stay back and ride this retrogression storm see some relief while you are still trying to adjust to the changed environment of your home country. You may even get tempted to come back and give the GC thing another shot but then you have to start at square one again.
Going back to home country only because of the shortcomings of GC process is like deciding to take a sanyas because you are tired of dealing with social issues. I belive a decision to renounce something should only come from a position of strength. A true jogi is one who understands the triviality of society and decides to rise above it...not the one who denouces it because he can't deal with it.

Of course, much more work needs to be done here... hope folks in NORCAL are listening!
At my workplace, about 50% of them have have signed this letter now! This is including but not limited to employees with an immigrant background ( including but not limied to the Indians and the Chinese!)
My tally is now up to 253. Expecting another 2 this evening from a friend who got it from 2 of his own friends.
Recruit friends & strangers to help you, then follow up a little bit, it helps!

Do you guys think its worthwhile to go back instead of trying waiting for the retrogression to end. From the looks of it, i doubt there is any chance of an immigration bill before the elections. if there is no bill then we will end up waiting for 8-10 years for the dates to be current.
if they remove the US masters from the quota, imagine the rush it will cause in the universities, effectively it will imply that you will get a green card after you study for 2 years in US. take a 20-40k loan and get a GC. There is no country quota for F1. i had friends who were rejected for F1 because they were 'potential immigrants' wonder how this theme will play out in future.
from this shore returning back seems to be an alternative worth considering...or maybe its just todays depression talking.
Another perspective is that if people with Masters or higher degree are exempted from the EB quota, it will in fact help in moving the priority dates current, since there are lot of people in wait who already have advanced degree from US universities and won't be using up the visa from the EB quota.

1. You are continuously employed WITHOUT any gap, meaning working 40 hrs/ week and clean history of pay stubs, W2s etc
2. You have been working for only one employer at any given point of time, as a full time employee
IF What i said above is true, then RFE makes no sense. because based on the H1B rules and regulations, one can have multiple H1Bs BUT can only work for ONE employer as full time, meaning 40hrs/week.
It is also completely legal that one can work up to 20hrs/week for second employer by paying proper taxes . but in your case i believe that you have worked for only one employer and i think you can show the evidence.
Please contact your attorney and draft a response carefully

Include Sep approvals as well, they can’t use all the visas in the month of Aug it self, it never happened before (in fact they wasted thousands of visas by the end of the fiscal each year in the past). This is the first time they have determined (?) to use all the visas, don’t expect 100% success in the first attempt it self. The system has not been fine tuned yet to that level of success.
For Sep, the EB2 dates will remain same or might even move further few months. Oct bulletin will be the interesting one. If there are very little approvals during Aug & Sep, it will move back considerably. If there are so many approvals in the tune of 15-20k, then EB2 PD will go back slightly (say Jan 06) but will move forward at healthy rate. Come last quarter of 2008-09, there will be quantum leap again.

They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.
