and few others totaling Top 6 media strong & political Big at Washington
Send flowers for 100 days campaign...10 flower bunches a day to each
60 Flower bunch a day - 6K in total for 100 days.
Considering each one costs with shipping 25 bucks....

No you can't. You must have filed separately. You could have amended your return to file jointly, but not the other way around.

So, I can do it that way (file separately first and get stimulus and then amend the return to file jointly after I get stimulus) only for tax year 2008?
(IRS website also says if u do so, you dont have to return the stimulus benefit - unfortunately this clause was added only on 04/14/2008!! according to IRS website).

140 reached NSC on July 11.
Receipt date is July 17, attorney says they got it today, July 24.
So for those at NSC who filed within a day or two of me, mght be better to hold off for a couple of days before filing 485 with the colored sheet which will probably add some delays in the mailroom

There is something with the french language it self. All the people who speak french as their native language, tend to be a$$holes, of varying degrees. May I ask where you got the 90K number from? I saw "12K unused last year" floating around.
Please don't shoot me for these thoughts, but please consider it only for sake of discussion.
Now that CIR is defeated again for nth time, We really need to consider rethinking about our stratergy,
I guess we are about 15K membership and if we include spouse and take a guess every one in five has dependent kid to join (wild gusstimate) we come close 35-40K approximately.
most of us are legal and we should not having any issue in getting Green card with current law only if backlog is cleared and we recapture visa numbers.
to recapture visa numbers we don't need any legislative reform AC-21 does apply,
We need to spend more energy in researching possibility of recapturing 90K visas and we will be done,
I really don't think we have strength and will power to fight legislation change along with illegals for most controversial subject.

Ok..I know I should read thru the older posts, but didnt get a sense of what is required in my case, so I am posting the question online.
My wife was on her independent H1B. she travelled out side the country and was readmitted on H1b. After that she turned in her 2 weeks notice and has started working for another company on her EAD.
We have not applied for our AP previously.
My question is this:
In Part 1 , Q3
Class of Addmission
Should she put H1B (last admitted as)
or would it be Adjustment of Status (since she is using EAD)
Also, what kind of supporting documents need to be sent?

Buddy...take it easy on yourself. I can feel your pain, waiting for almost 10 yrs now...still no sign that this wait will end anytime soon.

USCIS cannot approve my GC for years and years but now abrubptly they approved my EAD in less than 15 days, when I was expecting to get 2 years extension. My EAD app. was sent out on june 9th and my lawyer told me that they saw approval from yesterday 6/26 (wow 16 days including shipping!!!). USCIS always has hidden agenda, and everybody can tell that it is just money, which leads to such decisions. No body would forget last years july fiasco when they hushed up GC visa numbers for rendering people not to apply before fee hike. The present EAD issues everyone is reporting here is another fiasco. I wonder if there would be barrage of lawsuits for EAD fiasco as we saw last year for july fiasco. Now I understand why USCIS gave themselves time till 30th june, otherwise why wouldn't they make 2 year EADs effective right from the day of announcement in early week of june. Smart move!

Update: In the subcommittee hearing tomorrow let us expect our issues raised. IV has successfully communicated issues of IV community to the subcommittee members. Let us wait to see if all of those are addressed in questions. This is all possible due to support of members who contribute to help us with lobbying efforts.

A good attorney should be able to get those who availed themselves of the AC21 opportunity free and clear in their green card journey. The law seems pretty clear on this to me.
This is clearly a big deal for much of the IV community, who are stuck in this process due to inadequate EB visas and inefficient immigration service center processing.
I believe this might end up needing a class action litigation (for violating AC21 law) and an immigration attorney could make a name for him/herself in the process of this case!
Witness Carl Shusterman's challenge of the USCIS's erroneous interpretation of physician NIW laws and his subsequent stature in the field.
If there are adequate numbers of you, which based on this thread there seem to be quite a few, then approaching a good lawyer to represent the group pro bono and getting this mess sorted out for good might be a consideration.
Any thoughts?

India would be a good option for an Indian. For others I still think Canada and Australia are are the best options after US, in terms of standard of living, quality of life etc. It will take India decades more to achieve the same standards.
Actually its the quality of life why people are here on H1B.

Sen. McCain, a "Maverick" whatever that means, is a close friend to Sen. Lindsey Graham of SC. During the 2007 CIR debate, in the context of skilled immigration, Sen. Lindsey Graham commented - we do not want anymore Indian PHDs coming into US. Sen. Graham was talking about high-skilled immigration in general. Though Mccain supposedly makes his own decisions, the future looks bleak with either candidates.
I think many people on this and other forums would love to see President Obama due to opposition to war and slogan of change, to some extent - myself included. But most of us do not fully know the after-effects on this community. Get ready to feel the wrath of Sen. Durbin. It will get real nasty.

+ its better for the world in general. The last thing we want is more of GWB policies destroying both America's economy, civil rights, and respect in the world.

Rember her trying to get her brother-in-law police officer fired during her sisters divorce? And when the administrator refused her requests, he fired him? Remember how she emails people off-the-record from her Yahoo account? Remember how she CC's her husband on official emails? Do you want someone that stupid, who already abused whatever little powers a mayor and governor has, to be the commander-in-chief of the united states armed forces?
Either way immigration-wise we are screwed. I think for the sake of the rest of the world we must wish that this time McCain loses this election. He has made a very stupid VP choice.
