Kartik, as long as we, the EB3 do not come forward and collect huge amount for lobbying, we will continue to lurk here for many more years.
Unfortunately the sad part is, whatever lobbying is done actually helped only EB2 I, may be due to a wrong notion by USCIS that all Hi-tech immigrants are EB2. This could be a fact as there are thousands of 245 cases that fell into EB3.
Another bad thing was that USCIS release this VB yesterday which means one extra day to CRY.
I do not blame any one, but ourselves. We do not want to spend money and hence dying in this process. No solution, but cry at every VB day.

I really appreciate your effort and time spent on this cause, I understand this idea was discussed before.
Please update why this idea is bad, I know we can not sneak in any immigration bill thru budge or any other bill, but we should be able to bend few arms atleast to follow the law and use AC21 which is very subjective.

If you want some good reasons why H4's should have work permit read this
All these years the United States of America denied work-permits to
dependant visa holders with one simple explanation "You are in USA
because Your Spouse is allowed to work here". But numerous surveys by
different social organizations has thrown light on the darker sides of
the life of dependant visa holders.
The dependant visa holder has to forgo his/her career growth in-order
to stay with the spouse. This causes a big gap in the career and
finding a suitable job in the home country becomes difficult when the
pricipal visa holder has to leave USA and return to the home country.
If the dependant visa holder's field of study or work is, one in which
getting a sponsorship from an employer is difficult, getting a
work-visa is almost impossible. He/she even loses his/her hard earned
skills in the respective fields due to the large gap in career. Even
though volunteering is possible, most of the volunteer jobs might not
utilize the persons skills.
Studying in the USA is good option but, being a single income family,
it will affect the financial satatus of the family if other members of
the family (children) are studying.
90 percent of dependant visa holders are women. Women being, more
susceptible to domestic violence by the partner, becomes even more
prone to violence due to her complete dependance on the Spouse. They
become prisoners in USA due to the spousal abuse and immigration
policies that give their husbands complete control over their lives.
The immigrant Women get protection under VAWA but non-immigrants are
not covered. Even if a law to let the non-immigrant battered women to
obtain work permit is introduced, It might not protect women whose
cases dismissed as non-critical. The abuser can furthur exert his
control over the victim and convince her that he has changed so that
the victim might not press charges against him. Thus the abuser gets
encouraged to continue violence.
Divorce is not an option because most non-immigrants come from third
world countries where a divorced women has to bear the social stigma of
divorce and will not be protected in her own home country.
Because of the long queues for Labor certification applicationa and
retrogression of visa numbers, getting an EAD and Green Card takes
longer.
Most European countries issue work permits to the spouses. Also the
time taken for permanent residency is lesser. In USA L2 and E2 visa
holders can have work permit, but the other categories are ignored.
Fear of flooding the labor market is not a valid reason to deny the
dependant visa holders work permit. Allowing the L2 and E2 category to
work didn't create any marked increase in the unemployment rate among
US Citizens.

Hello,
I have a few questions regarding the application for AP for a dependent, and I would appreciate it if someone would answer them.
1. If the dependent is applying for AP, should I include the primary applicant's I-485 in the application packet?
2. The dependent has an EAD. Is it necessary to include copy(ies) of the EADs with the AP packet?
3. If the previous AP has expired, is the applicationo process for a new AP different from that if a non-expired AP is being renewed?
4. I was reading in some threads that the $305 fee will be waived if there is a pending I-485. Is that correct?

Senator Frist bill is better as it has no so called 'Guest worker' clause.

My I-140 was filed on July 6 and arrives at USCIS on July 9.
The check was cashed on July 12 and I was able to get the receipt number. BUT BY NOW I HAVE NOT RECEIVE THE RECEIPT. It seems many people are in the same boat. What we can do about it?
Anybody knows how many days it would take between they cash the check and mail out the receipt? What address do they use?
Did u get the receipt number on the back of the cheque or did u call USCIS and get it ???

Congrats.Techically speaking dates were current when you applied.It could be that a few lucky ones like you would have been alloted a Visa number then .Enjoy......

According to the first guy I talked to, one has already been assigned upon the start of processing of the case.
I just called again and the lady was completely clueless about the whole July 2 fiasco. I will try again in another hour and hopefully I won't get the village idiot again.
For anyone interested in calling themselves here is the info: 1-800-375-5283 options 1, 2, 3 (and possibly 6 after that-I can't remember).
Visa is generally assigned to an application only if it has cleard background checks etc...and ready to be approved... They never assign Visa on receiving the application

I filed I-140/I-485 April 22 and received receipt notices. No appointment letter for finger printing yet and no LUDs. Texas currently processing date is April 28 for EAD. Sould I be worried?
If you e-filed and no FP notice then you won't be getting EAD in 90 days.
The day you get FP notice from that at least two weeks after FP will be scheduled. After FP it takes 2 weeks to further processed (Card + approval).
Although USCIS says to contact after 90 days, you should think in terms of getting infopass.
Could anyone else provide some more input?

First - EB2s stop replying posts that were written in frustration and you understand why, They will not affect and take away your GC. Since you are not frustrated you have to start first.
Second - EB3s - Frustration will never bring you anything and you can not move PD faster. Instead capatialize the situation that EB2s are getting GC. How you have to think and focus.
I can give my example. I made network of some who got GC and have some influence in recruiting. After working 9 years for a big Pharma and got layed off, My one buddy got GC long back in EB2 , helped me and received job through him though I have to drive 220miles everyday.
Am I frustrated yes!! More than anybody else here but has to calm down and think positivily.
Hope my post will help you to reduce some frustration.

Called uscis and asked what happens to the app already received by them?
The rep put me on a hold..(guess went and asked somebody) and answered that all the app received will be put on hold(not returned) and said they will not process ead/ap too.Di anybody else tried calling and ask the same?did they tell the same thing?Just want to know if i interpreted it right?

I am with you buddy, but u have to understand
1. AILF will not file such case as they dont have big numbers of people supporting it as plaintiff
2. Your reasons are justified but you forgot one thing: US govt agencies (whether it is USCIS, DOS or DOL) treat immigrants as with the principle "beggars are not choosers", so per them you as an individual and your feelings doesnt matter much
3. Try to think positively, even though everyone will file 485 now but come Oct and if your labor is approved by that time you will be much ahead of everyone and you will not loose your place in the line. I am sure u will get GC approval before most of the July filers

chaanakya, why do you have a problem with the donors? if you don't want to make any monetary sacrifice that's fine...nobody's complaining. Now it's only fair that you don't complain when people making additional sacrifice are given some recognition. Don't mistake...those donors also make all other forms of non-monetary contributions. Have patience things will work out slowly but surely.
