Gurus please advise,
I have a H1b with Company A. It expires in Nov 08.
A couple of months ago I joined company B and they transferred my H1B.
Now if I want to go back to Company A, do I need to transfer my H1B again?
Company A has not cancelled my H1 and I am in good terms with them.

It amazes me how people like you exist in your lala land...why don't you also change the congress and the the house rep that way you will get exactly what you want. Sadly you cannot even vote right!!! You can be critical of IV if you have a basis for your argument most of us like to sit on our lazy boy and do nothing. So instead of saying we need a change why don't you do something about it empty words mean nothing in this forum.

But I am writing this for the benefit of IV and please take this as constructively as you can. As a member, I have full right to suggest a change of leadership when I think it can help.

bigboy.. We need about 20 volunteers per state to pledge 200 letters each. It is achievable. But 20 volunteers is far from reality. That is our challenge.
Friends Please dont jump on me as i make these comments. I am doing my best to convince ppl as i see across to Join IV and contribute to our efforts. But i also think that every state chapter should allocate some members who only concentrate on grass root efforts but nothing else to track how many memberships and etc and those should co-ordinate with every state to see how much they can target and how much did they reach. I know this might have been thought by some others but just what i am thinking ?

I know you have been correct in the past but I think we have just gotten over the hump of 2003 and a small portion of 2004 for EB2. The majority of 2004 and early 2005 still remains. There was a huge jump in March 2005 to beat PERM. I dont understand how it will reach 2007
Here are all the LC approvals for India in the last seven years.

I dont know the whole background...but they say they will use 5000 unused visas per year. Where do these unused visas come from? FB visas?
Ironic if it FB...that is backlogged years - close to 10 years for some categories and there are unused VISAS....God I cannot understand this..ONLY IN AMERICA THING I think.

hermione has been very active in helping with battling immigration backlogs in general despite her "oh so close to green card status". she was responsible for one of our better pre rally videos as well. guess we can put it down to not tolerating the whole mess :-)

I guess the cat is out of the bag. Yes, I got my greencard a few weeks ago. Yes, my PD is early 2004.
There are 2 current theories why:-
1. I'm very vocal in the media and lawmakers about the problem, and something made this happen (as my co-workers say "they gave it to you to shut you up")
2. I was a lucky one that was assigned a visa number in early June (when I applied for AOS) - it was approved when my PD was not current.
I'm not going anywhere, nothing has changed with the current policy. It is still broken. If for no other reason, the bizarre circumstances around my GC highlight more unpredictability and uncertainty in the whole process. I hadn't mentioned it before since it really isn't a big deal in the big picture.
Congrats.. and good to know that inspite of getting GC you have decided to stick with non-GC holders like us...

If you get an MBA from Sloan or Wharton or Harvard or Berkeley, nothing like it. I know of few people who have not done very well after getting MBAs from these schools. If you want to continue writing comp. programs, then of course there is no need for it. But how many people want to do it forever?
But I agree with Tito to some extent. Especially, if the degree is from even a slightly lower ranked school like Arizona or Northwestern, the returns are not there, and there is a great deal of evidence in that direction.
Having actually studied this data (and being in the business of teaching) gives me some perspective.
But it's still just my 2 cents.

Thanks you all for making the post and clarifying the difference between I140 substitution vs underlying labor being used. I guess in my case the approved labor was used and not I140. I have asked my previous employer to send us the revocation request for the I140 so that my MTR is much stronger. The 2 applicant to 1 labor/I140 is exactly what has happened in my case. One of you has done a very good job of explaining it.
My current lawyers are in the process of filing for MTR. I have been delayed a bit since we never got the damn letters. I have H1b until June as a backup. My wife works on EAD--should she inform her employer or she could continue since they don't know yet.
I will continue updating this thread.

I have one question regarding your view. Actually point system gives points to the US experience and employer sponsorship. Because of limited number of greencards Those who are not having both of this may not be able to get green card. If you give your calculation everyone will get clear about. I think MS with 5 year US experience will get more points than fresh Phd. That serves the purpose. If that is the case then only eligible people will get gc.

Merits based point system awards supplemental points for illegals. Being illegal is not an accomplishment. Having an MBA or MD is. The two cannot be awarded merits on the same scale.
Merits based point system works well in countries that dont have annual caps. Like Canada. Their objective in Canada is to fill the country with younger working population in order to balance to demograph that is headed to an aging population. USA is not like that and having points system in conjunction with numerical caps will cause greencard to go to paper-tiger resumes that have lots of points but not employable. There are millions of Ph.Ds in Science in India and China and they would not be employable here but would get GCs. Just like Canada, we would have greencard holders with Ph.Ds and MBBS driving cabs. Employability has nothing to do with papers that prove how many years you spend on colleges accumalating degrees.
A bachelor's degree from Harvard and a Bachelor's degree from Rutgers would get same points : 16 points. Is that really a measure of merits?
But again, if you feel that point system is great, issue press release on your own and peddle your agenda on your own but dont use this site to peddle that agenda. You are free to discuss with other members but dont issue press release and dont speak to the media on behalf of IV. Speak to the media as an individual.

I say it, others just do not say it. I have openly criticized Murthy and even Khanna in my old posts - but now I have my highest respect from them, Murthy cheered the crowd like anything and priased all the grassroots efforts.
If people cannot get motivated - it is their EGO and SELF PRIDE that stops them.
Once again - everyone feels it - I say it. I once openly critized immigration lawyers for their ways of handing things which is very obvious on Rajiv Khanna's forums, some people tried to attack me saying that I am not giving the right message but the other members said "We have it in our minds and you have openly expressed it"

My PD is Dec 2006. I got my EAD 15 days ago and the card is valid for 2 yrs. So the guy that approved my card doesn't believe Dec 2006 is a possibility this year!

Suppose I initially worked as an Engineer, and got labor and I-140 approved. Now, say I totally change my field to become a Business Development Manager, can I still port the older PD from the previous I-140 (assuming that a new labor and 140 will need to be filed for the new job) or does the job have to be same or similar for me to port the older PD?

Of course. In fact this type of career change is required if you want to port a PD (EB3->EB2) while using experience gained with the same employer to qualify for the job.
