You'd certainly find the poetic notion in the constitution that "all men are created equal" but if the purpose of the US government and its agencies didn't allow them to balance this with protecting the interests of the US public, a billion people from around the world would move in tomorrow. By your logic, an illegal or one with visitor visa would apply to a job he's qualified to here then sue USCIS because their stupid rules that do do not treat him equally like all other men cost him the job.. Congress enacted the INA (Immigration and Naturalization Act) and tasked USCIS to enforce it.. I researched Title VII and the INA in my paper (so much fine print than the highlights u mentioned) and can tell you that title VII specifically allows INA to override it in matters relating to Immigration, and in many cases INA obliges and in many cases walks all over the EEO and all men equal concepts.. as i discussed with my employment law professor who had a good background in immigration, the situation can't be changed without rewriting Title VII and the INA..
Anyway, just my professor's opinion and mine, u have every right to disagree but plz let's do something instead of talking..

I therefore believe there is a good chance at the Supreme Court ruling that because of long wait times of more than 3 years for a Green Card plus requirement of same or similar job during that long wait until the green card is received plus country quota affecting people born only in few countries leads to disadvantage for people of these few countries at work.
And yes, even I took law course and gave a seminar during my MBA. But even you would concur that this course at best is basic and does not make a person authority of the US legal system.
Finally, forget me or you, even a lawyer cannot say for sure what the final ruling will be in any case. And hence the best a person can do is give an educated opinion. In addition by human nature, the way I would interpret laws would be to my advantage while the way you would interpret them would be to your advantage. And hence I can understand your biases (and mine as well) because in case the country quota is found illegal by the US Supreme Court, it is the ROW that is going to be affected the most.

Quick question on behalf of my friend. His H1B is being revoked by the present company. His previous employer did not revoke his H1B, can he go back to the previous employer without filing for transfer or should he file for the transfer again?

This question is not to undermine the effort, which was tremendous but just from a realistic point of view...
I'm just curious to know how long it will take (or rather how long we are prepared to wait) for the impact of this rally to be felt and what are the changes that can be expected from USCIS as a result ?
Say, after waiting for a few months, status quo continues, what further actions are planned to persist with IV's cause (i.e. more rallies or by other means) ?
If the same question has been already raised, please ignore.

Change always takes time. Being in DC and visiting lawmakers was an incredible crash course for me in the practicalities of American politics. It was fascinating. I have to say it was one of the most satisfying things I've ever done in my life.
Whilst we are pushing for rapid changes, the realties are that building the type of relationships that we were doing in DC can take time to foster change
Anyway - lets close the thread. I was hoping to get some better information about how we can improve our motivation techniques for the future. I got many answers...

I flew Air France once in 2003. My connecting flight from Paris to Delhi got delayed by 12 hours. When I approached the Air France staff, they told me that since I had an Indian passport, I would have to wait out the entire time in the transit area. Meanwhile, they proceeded to make arrangements for other non-Indian passengers. They even refused to acknowledge my attempts to reason with them, either not replying to me, or replying only in French. I filed a formal complaint afterwards, but never got a reply.
I have travelled on numerous times since then, but never with Air France. I don't even consider them as an option anymore.
Sparky I had same experience in 2003 only my next flight was after 24 hours. They refused to accommodate me in a hotel or on another flight though they had sense to issue me a calling card for 10 euros and a meal coupon. I have never flow AF since that day (even if their tickets are cheaper) and neither has any of my friends or family member. Every time I hear somebody is planning to fly to India, I tell them my story and trust me nobody I know has flow with AF since 2003.

Does US immigration check up on this stuff? If so, how? I'm thinking that the Texas processing center (where my info is being processed) is too busy working on my papers (and other folks' papers) rather than inquiring about everyone's employment status.

I would love to get a free lunch but facts are facts. I will not argue with you or about you but when and if you can refute ANY of the following statements, do write back and we can have a healthy discussion on this forum:
1. Why does Walmart/Gas station charge me money? I pay for a service or product I want which they give and have irrefutable proof that they gave. IV has no such proof of anything it has done for anybody individually or as a group on this forum.
2. You buy bandwidth and free lunch by donating?? NO. Do you see that big ad for a lawyer splashed on every page? That is what pays for the bandwidth. Many "non-donors" answering questions for each other in this forum or just by the act of engaging in fruitless discussions with you is what is paying for the bandwidth.
3. You seem to be under the impression that IV got the visa-bulletin reversed??? Moses, wake up and smell the roses. The massive class-action lawsuit being pursued by AILA, the Silicon Valley lobby pressuring Zoe Lofgren, almost all immigration lawyers asking people to join the class action .. what about all of that? Do think your 25 bucks on the flower campaign is what got the bulletin reversed?

Hi,
I have filed my H1 (premium processing)on 26th Sep and till now I didn't receive my H1 receipt.
What could be the reasons and how i Can track about my case.
Can I track my case? is there some number where i can call discuss about my case why I didn't receive my receipt
My Lawyer called the USCIS and they are saying that they are not able to generate the receipt number?
Is somebody else faced the same issue? what could be done now?

My experince in porting EB3 to EB2.
One of my friend labor was applied in Eb3 since he was not eligible for eb2 in 2002. His labor and I-140 was cleared in 2006 and waiting to apply I-485.
Meanwhile he got promotion in same company. So he applied for EB2 labor.
(If 50% of job duties change you can claim experience gained in that company.)
He applied another labor in Eb2.
Eb2 labor cleared from same company.
I-140 cleared (ported old priority date.)
Applied I-485 in early 2007.
He got GC by end of 2007.
My case was also similar.
My labor was applied in 2002 in Eb3 since i was not eligible for eb2 in 2002.
Labor and I-140 cleared in 2006.
Got promotion in same company. I asked my company to apply labor in EB2 and port PD. They agreed to pay potion of the cost.
My Eb2 labor approved in 2007 (perm)
I-140 approved but Texas service enter screwed my case they did not ported by old priority date. I-140 approved with PD date 2007.
My attorney requested USCIS to port PD but no luck till now.
I spent 7000$ for this.
Bottom line is Porting of PD from Eb3 to Eb2 worked for some people only.

I hope they have some kind of link with DOL. Because my approved labor case status changed from Certified to Data Review and back to Certified.
Where did you see the change in case status? Do you have access to the PERM system? Are you the employer/representative of the firm responsible for PERM??

E-Verify is free and more than 87,000 employers are enrolled in the program. According to U.S. Citizenship and Immigration Services, more than 1,000 employers voluntarily sign up to use E-Verify each week.

i dont think its a controversy. mr. Gotcher does not agree with the interpretation. Maybe its a way to generate some additional revenues for his firm by increased traffic to the blog and potentially a class action lawsuit on behalf of the ROW people.

I dont think filing EB2 is that easy. First condition is not that candidate likes to be Eb2 that drives the labor application (I wish that was the case then every one would have asked for EB1) it is the job requirement that should be able to qualify for EB2. (for people working in large corporations this will be the stumbling block) for people in consulting business this is not an issue but in this tight market with A2P and wages could spoil the party along with DOL activism for audit does not mean things will be piece of cake. For EB2 from candidates side he/she needs to have MS preferably in same field as work ( So MS Mechanical working as DBA might face RFE to explain) or the previous work experience might be scrtunized more to validate it satisfies the labor requirements.

I BEG to differ. I called USCIS today morning and the rep told me VERY CLEARLY that ANY application received on July 2 will be ACCEPTED as July 2 is the cutoff.
A few min later my spouse called and they told her, Everything would be rejected.
USCIS customer service center, currently cant differentiate their A** from a hole in the ground!!

Earlier today I got an email from USCIS that said
"Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Card production ordered.
On June 29, 2008, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register."
Then by the evening my I-485 said
"Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Notice mailed welcoming the new permanent resident.
On June 30, 2008, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before you get your new card call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register."
Problem My EB2 PD is not current, is this a system glitch or did I get GC?
