    Guys this is great, we can all ask our friends and colleagues to sign letters and we can all secure them by paying for the stamps ourselves. I am not sure my husband knows I have shares in the post office now, but I think he would whole-heartedly support it, and he supports what I am doing!

    My wife moved from H4 to H1 in June 2007 and obtained her SSN at the same time. We used her new SSN to file our returns in March this year. However, no sign of the stimulus package yet. Wonder how is our case being considered. Thoughts?

    Great points. Is it possible for the primary applicant to continue on H1 and the secondary/dependant applicant apply for EAD?


    I have the same issue now , my h1b 6 years end in 2007 december , h1 extensions are granted only if the labor is pending for more than a year or dates are not current for 485 ...


    So I guess we are better of being on EAD rather than on H1B because of all the bad publicity associated with it now a days and kind of restrictions they are planning to bring on H1B.

    Even the dual intent is gonna be removed if the bill passes in its current form. Looks like senate is trying revive that unwanted baby called CIR ....

    Even if CIR fails , the chances of enacting 1035 on its are very high So in a nutshell its better to get to the 485 queue and wait so that they will start some preprocessing on 485 applications after year at least.

    All of us know that dates will move back and we have to get ready for that ..

    refering to raju123's post of the aila document text: aila says that the amendemnt S.AMDT1249 could come to the floor or could be negogiated into the final version of the bill - so there is quite a chance that this amendment could be passed - hopfully w/o any changes.

    Also on another note Senator Lieberman wrote a piece in investors.com which is pro-skilled worker and pro-H1B.

    Is the senator trying to come up with another amendment ? any which way lte us hope either 1249 or a possible Lieberman amendment passes.

    I called USCIS today and they asked my name and date of birth and they gave me my Receipt Number for I-140.

    My I-140 was recieved on July 16th and they generated a receipt notice and have sent me...I shud probably recieve it by this week.

    Hope u all also get it soon...

    A. You will need to wait until you file your 2008 income tax return to claim the economic stimulus payment. [New 4/14/08]

    You file your 2008 return in 2009.

    EB2 dates may be unavailable/ dont move. But it is just for a very short span of time. And after that EB2 dates start moving quickly again. I presume by 2009 october, the EB2 India PD will close to 2008. Any retrogression, if ther is, in EB2 will be very mild from now on because of the spillovers.

    Regarding EB3: Every year there had been about 100k approvals in EB3 category, out of around 160K(even though there are 140k visas, there have been approving more because they are using unused family visa numbers) approvals in Employment Based Category. This is because of vertical fall outs of visa numbers. Now they have changed the scenario to horizontal fall outs (spreading across at the same category level( ex. EB2) irrespective of country of chargeability.). So this time it would be around 100K approvals in EB2 category.

    Let us make as much noice as we could because of EB3 retrogression. That doesnt effect EB2 movement. But may make it possible visa numbers increase for EB category by legislation. So we have to support this agitation made by our EB3 friends.


    I could seee all the EB3 folks with PD older than 2006 and EB2 folks with PD older than 2008 will be cleared off in the next two years. I am sure there wont be not more than 1 or 2 years delay between EB2 and EB3 categories in near future.And there are lot of things going to happen for employment based immigratin in the next two years.

    We are quick in jumping at each others throat for no apparent real reason ! Being part of a forum is sharing space with others, with those whom you disagree, and those who disagree with you. Argue logically, but don't make it a personal fight.

    Don't agree with someone, make your displeasure known. If things seem to be getting hotter, ignore the other person. Live and let live. We have bigger issues to worry here - GC mess - instead of who said what !

    Hi guys,

    This is what my lawyer said.

    If you/spouse have used your EAD or are using your EAD then your "Current Immigration Status" is "Adjustment of Status Pending/Parolee". If not then it is either H1B or H4.

    If you/spouse have actually travlled outside the US and re-entered using the Advanced parole, then your "Manner of Last Entry" is "Parolee". If not then it is what it says on your I-94 (H1B or H4).

    You do **NOT** need the $80 Biometric fee for the Advanced Parole.

    One quick question....if the spouse is on H4, working on EAD and then travels outside and comes back in using her H4....can she then still use her EAD.....??

    Actually some of concern of EB3 is valid.But their explanation cannot convince DOS or USCIS. According to DOS/CIS EB1 has more skills than EB2 and EB2 has more skills than EB3. That is not true in many cases. EB1 most cases are genuine except some cases in multi national managers. A manager in CTS could file in EB1 but at the same time similar manager in Intel cannot file in EB1. But only very few are in numbers because of restrictions like working in other country branch etc. So people do not bother about EB1 being current always.

    Coming to EB2, the job requirement require Masters or 5 years experience. If the requirement is genuine then it is ok to give priority to EB2. But in reality(mainly consulting companies) the job requirement is decided mostly in Lawyers office or by candidate just because candidate has
    master degree or 5 years experience. Though CIS scrutinise the EB2 applications still rejection rate is less. And also many persons trying to use 3 year degree and 2 year Master and apply for Eb2 by adding PG diploma etc.
    So it appears that there is no difference in skills between EB2 and EB3. If CIS and companies follow strictly the law and good faith then number of candidates would have been less in EB2 and EB2 would have been current and remaining would have been transferred to EB3. But these reasons could not be given to DOS/CIS. According to DOS/CIS EB2 has more skills than EB3.

    Are u saying all eb2s have earned the experience under the table. Then why couldn't you do so then ?
    Dont blame the lawyers or the employers. May be there are one or two, which I am yet to find. But if you have seen it and very sure of it, why didnt u complain about it earlier to the appropiate officials.

    I know IV is doing its best and there are other groups fighting for HR 5882.

    But honestly, what are the chances for this bill to succeed this year (before election)?

    100% or 75% or 50% or 25% or 0%

    Ron Gotcher predicts that none of the individual bills may pass this year.

    And also that EB3 I may not move forward even next year!

    I am not sure how many EB3 (I) volunteers are there in IV (who are really focussed). Are they getting nothing? The prediction is that EB3 I may go back to Nov 2001 and stay there for a while (or may be for the rest of next year).

    Is the efforts of EB3 (I) volunteers being exploited (indirectly, of course)? What are they fighting for?

    Here are some of my own personal thoughts:

    How can one tell a percentage number for something to pass? What kind of data can we base our calculations on?

    Who said EB3 India will not forward next year? Did DOS say that? An individual lawyer is not Dept. Of State. I would like to see a written proof from DOS saying this so that we can plan ahead.

    There were many naysayers for the July 2007 bulletin. But IV was able to get it current again. So stop believing in predictions and believe in yourself.

    I believe it is immigrants more than anyone who will benefit the most from the success of IV's efforts. Thus it is in our interest to make IV successful.

    Everyone is free to take part in IV campaigns. Nobody is being 'exploited'. However, if we had a more massive effort for admin fixes, we could have seen better results. With only around 5K letters (and that too a lot of anonymous ones) you cannot expect something to happen quickly. If you are trying to convey a plight of hundreds of thousands that you need hundreds of thousands of letters.

    Likewise if you need these bills to move, we cannot expect a couple hundred calls to bring a bill on the floor.

    IV is IV members. It is what each IV member decides to do that decides the fate of any campaign. The contributions received during the campaign also decides how much we can invest in our lobbyists. During the past 2 months we were able to collect only $16656 (refer this thread (http://immigrationvoice.org/forum/showthread.php?t=18790)). You can do your math and figure how much we can lobby when we have opposition that can spend much more.

    IV can be successful only when its members want it to be.

    PD Nov 2001 - Nov 2002 -> I would say no point in switching to EB2.

    Labour + 140 will take atleast 12 months and another 6-9K US$. Not worth it because even otherwise you might have your GC within 12-25 montha from now.

    PD Nov 2002 and beyond : Have to actively consider switching to EB2. Myself being in this range, I am doing the leg work and waiting to hear on what happens to the recapture bill. If it does not happen then these PD's should switch if they can and qualify.

    Instead of being jealous towards EB2 bonanza , I think EB3 applicants should make use of this Eb3->EB2 conversion option and participate in the bonanza.

    Yes, it costs additional 9K . Consider that the price of the ill advised decision to go in for Eb3 to begin with.

    An opportunity to get past this GC mess and start realizing your dreams on both personal and professional front.

    After thinking about it, I feel very very sorry for disrupting the cheerful atmosphere on this forum. It is time for champagne, not complaints. This should be a place to congratulate and applaud IV's achievements, instead of that to express one's own frustrations. People with 07 PD has the privilege to cheer when they cut in front of us, but we should not feel sad for being pushed back because it is a disruptive behavior.

    Please do not list what you have done to add items in the legislation to help BEC victims, it does not look genuine any more when it is considered disruptive to express one's depression on a board specially for BEC victims.

    This will be my last post, as I am sure they will ban both my ID and IP. For everyone who still reads my post, Good luck!


    I admire your courage to stand up and apologise. I wish you all the best, and I hope they lift the ban. You are the type of people we need. Be positive, there is a line for green cards and I didn't know people can jump the line. I need to concurrently file so I can get an EAD. I've been sitting at home for several years as a dependent.
