Pappu, then why no to plan for another letter campaign, if that is what making things work a little bit.
It will work only if we can have 10s of thousands of letters.
If admin fixes had so many letters we would have been in a better spot today. With only 5 thousand or something letters and many of them anonymous, we cannot have our hopes very high.
Unless people suffering take the initiative, our initiatives will have a hard time getting results. IV is every member here (and not just core members or chapter leaders) and if members feel the heat of retrogression, they need to take the initiative and get active.
Hope this bulletin will help people focus on action items.

I live in Georgia and I agree with you all. All these DMVs were sleeping and woke up after 9/11 and imposing these strict rules that makes everyone's life miserable. Unless you live in a city life will be hell without DL and we are sweating it over every time a renewal comes up. How am I suppose to explain DMV guy about I-94, H1 extension etc. Even some immigration officers in airport give wrong I-94 expiry date without understanding the difference between visa stamp and extension.

With the current situation, I think it may take 2 to 3 months...
Probable longer for an RFE. Receipt notices are taking 6 weeks+. When do you think EAD will come out. It used to be 60-90 days. With quite a few EADs out in less than 60 days.

- Came to US in 1997.
- Had Labor + 140 approved in Dec, 99.
- tricked and lured by start-up in silicon valley. Abandoned everything and came to California in Jan, 2000 made the deadly mistake of not taking the copy of approved I-140 (I still slap myself every morning for that mistake ;) )
- Found out they have only one customer
- Founder wasted own 20 Million dollars but never increased the tally for the customer from 1
- "Startup" went under in 2002.
- Joined new company (the only customer of start-up) and filed labor in March, 2003 and enjoying every minute of it... :)

Progress of PDs are similar the ones which happened prior to June 2007. May be there is a chance of repeating that now......

So if the pattern of last 2 years also holds this year, there will be slow month or 2 month movement until the last quarter (july/aug/sept) and then boom-bada-boom massive movement of maybe a couple of years. In that last quarter its all hit or miss, some 20-30% of people who get current will get GC (like what happened last year) then again back to 1 year of creep and crawl... hopefully by then we get some form of immigration legislation to clear this backlog.

I am not 100% sure but if person has not completed 6 years, he can continue till he completes 6 years. If person has already crossed 6 years limit, H1 extension or transfer does not stand valid without any underlying pending AOS. This is what RG termed as opposite to conventional internet wisdom. Also, the law requires to provide a notice to cancel EAD, but not to cancel H1B. Correct me if I am wrong!
Ron is absolutely right regarding H1 extensions past 6 years! If I-485 is denied, the extension cannot be granted (we all know that USCIS may still approve it, but if they follow AC21 guidance, they should not). As for cancelling H1, the law does require USCIS to provide notice in one case: if it determines that H1 holder is no longer working for the sponsoring employer. We already discussed automatic revocation scenarios.

Instead of ruining our life running after GC, here are few options
1) if you really want to live in a developed country, move to Canada or Australia. their process is much simpler and faster
2) cash out your investments and move to India. you might end up back in US on L1 :)
3) since some of us have had babies here, wait till they can sponsor you.
i have personally done 2 of the above. I have a Canadian PR and i have established contacts in India in case i need a job there. What am i doing here? saving as much money as i can, and waiting for the right opportunity in Canada or India. GC can kiss my ......., i got better things to do in life.
Let's stop wasting our time and pages on ALTERNATIVES (Canada, Australia, India, or timbaktu). Those who are serious about the alternatives just opt for those. We are here to fight our case for increased visa numbers and lets do that.

2. Did you submit a copy of the I-140 approval and the AC21 memo during MTR?

1. Yes, I have been having an attorney all the way thru the two MTRs
2. Yes, I-140 approval copy was present in my first MTR. My first MTR did not have AC 21 memo. AC21 memo (2003 Yates Memo) was present in my second MTR when we filed it. Of course, I-140 approval copy was there in the second MTR.

I just sent a check of $100 via online bill payment to IV. I've also set up recurring contribution checks of $25 every month beginning June. I strongly believe in IV's cause and hope that many folks will come forward. This is the time to act to help ourselves, otherwise we'll be left behind. Keep up the good work.
