What is fair is that we treat everyone here (and everywhere else for that matter) with respect without regard to the country of birth or the EB category. Some are more educated than others, some are more skilled than others, and some are more lucky than others when it comes to green card but what is common to everyone of us is that we are in this mess together. To be honest I don't think we are here to figure out what's best for United States, we are here to get our green card, live the American dream, and make the best out of it.
Therefore, let's not make this GC journey anymore difficult than it already is by fighting amongst ourselves about who is more skilled and who is more deserving. Besides, constant bickering among the IV members will only further divide and alienate more members and won't help us in any way so I suggest that we avoid doing/saying things that has the potential of dividing or alienating members.

Why doesnt US govt allow H4 Visa holders to work like Australian Govt does??????
Rather than crying for shortage of Manpower they should utilize the talent already present in the country. Has someone every raised this issue with the senate? I dont think so....and I think there is no forum also to take it up.

Some people advise to wait and watch and some people ask to do something else. I would like to say one thing and it is purely my perspective. People who are waiting inline for 8-10years does not know when they will be getting their GC in hand. May be in next four to five years. By that time on average their age will be around 35-45.
Do you want to wait 4-5 years and do the job which you were doing 10years back?
Did you had any vision for your career when you started your GC and life?
Do you have the same vision now for your career and life?
Did you feel you and your family have sacrified enough in your personel life for this stupid GC?
IF YOU SAY I HAVE DECIDED TO GO BACK TO MY HOME COUNTRY:
Do you think you will get a managerial job if you go back to india at the age of 40 when you could see guys @30 doing that job with ease and with better experience?
Do you think becos of 10+years of expereince in programming field, indian companies will recruit you for managerial job?
Are you willing to work in India as a programmer with 10+ years of US exp under a 25-30 year old team lead or PM ?
If you say YES , YES , YES for all the above, do you think any indian company will recruit a programmer at the age of 40? forget about the salary you are going to ask for your exp which they will never accept.
So at the end if you wait long enough for GC, then it is better to wait here until you get it. At least you can save your life though you have to start your career from -10years. If you quit and decide to go back to your homecountry, your life is going to be tough.
Options for guys waiting for 8-10years for LC:
1. Try to get PMI Certification, CISA certificaiton.
2. Try to get TOEFL, GMAT scores and keep it ready.
3. Try to get in contacts with most of your friends and manpower agencies in India.
4. If you file for your 485 in next one or one and half years, then proeceed with MBA plans(parttime or full time or executive MBA) in top 25-30 business school.
5. Your waiting will yeild fruit in this country only with MBA as in next 10 years, US will need more managers than programmers to manager all their outsourced projects.
6. If you do not have such vision and you are happy with what you are doing now and if your job is secured for next 100years and if you feel that you will be happy in future by doing the same job and OK with other kids going up the ladder stepping on you and if you are ok reporting to them and listening to them, getting bashed by them etc etc, you can very well wait for next 100 years hoping to get GC one day.
I am not talking about one guy in one corner living beautiful life.
I am not talking about guys who are lucky on everthing to get on time including GC.
I am talking about majority of the people and general human nature, people who came to US with a vision for their career and life. People who have had and has a spark in their eyes.

Hi folks,
My labor and 140 got approved and PD is march 05.
After the good news, I can apply for 485, But I have
a question. My wife she came on H4 here and then converted
to H1B and get stamped also. Is it going to be a problem if I apply 485 for
her ( because of H1B) and if its not a problem guide me what are the necessary documents
for her.

I really dont know what the purpose of this thread is, or whether it accomplishes anything.

May be you do not know the meaning of three red dots for TheOmbudsman (it used to be two red dots this morning), which is "so many IV members do not like his postings" i.e, TheOmbudsman is "anti-IV"
FYI, if he does not like a posting with the word "CIR", why can't he ignore the post instead of replying to it with an assumption "people who mention CIR supports amnesty".
IV members support CIR just because it has EB reliefs (manager's amendment) - is it not simple enough to understand?

You want to talk about Rumsfield's resignation and its relevance. Here it is: With Rumsfield resigning, the President has sent a clear message to Dems that he is more than willing to work with them. In the press conference at noon, the first thing Nancy Pelosi asked from the President was that Rumsfield should go and it happened.
Moving forward if anything has to become a law the Congress (which is Dem controlled) and the President have to work together else there will be nothing for anybody which includes Immigration Reform. I'm sure you know the President can veto anything. He can veto the immigration reform the Dems propose by saying its not along the lines he wanted it to be. So Rumsfield resignation is a good sign if you look at the over all picture. Please do not confuse with IV objectives with the Posts with someone who is not part of core team. IV's objective is always getting MORE visa numbers.
All these Horizontal vs Vertical etc all USCIS/DOS created issues. Whoever is benefiting out of this overflow, they are happy and others are not happy.
Last year during last quarter there was heated discussions between EB3-ROW and EB India. During that time there was vertical flow and EB3ROW got more visa.
If you ask me overflow should be evenly distributed based on the backlog of a specific category.
The % of allocation should be based on the backlog.
To do this USCIS/DOS should have exact detail and have a centralized process in place. Since they don't have this and changing this is not possible in our life time, everyone is trying to suggest to change to EB2.
Achievable goals or goals worth pursuing from IVs point i guess is
a) Visa # increase
b) Making USCIS accountable for yearly visa#
- In my opinion If there is no IV then even 140K visa allotment in a year, overflow etc,etc..itself would not have happened.
Thats why Always IV moderators and core team members maintained that only way out of this mess is "to increase the visa#".

H1-b 5.5 years, I-140 approved 1.5 yrs, I-485 pending almost 2 yrs, priority date just got current (JUL2004). Got laid off and will have January check as last pay check. Spouse is on H1-B, whose job is relatively secure for the short term, whose I-140 approved as well but didn't submit I-485 (PD is about beginning of 2007).
1) EAD/AP expire at the end of March. Should I renew EAD/AP now? The company will not do it, if I apply it on my own will CIS notice this and send me an RFE? If they do send me RFE asking for employment verification letter can I fax back a letter (I believe my company still counts me as an employee now) without letting them know I got laidoff?
2) Regarding H4 application: what's the best way to do it, apply on my own or use an attorney? Do I have enough time to do it in one month on my own?
3) If I find a new job quickly, given that I'm in my 6th year of H1-B, will the new employer be able to transfer my H1-B?

No its I-485 I just cut and pasted the two emails I received, first at 10am then the second at 3 pm check online and the system had same messages. If its true I am having a party wow man thanks I did come to US in 1997. I do have a labor which was approved under RIR PD date 2004 but the employer refused to file I-140. Then again filed PERM in 2007 under EB2 and filed I-140/I-485 based on this PERM

In our company we have an immigration chat alias and my colleague' friend's
wife's GC was approved and after a couple of months she got a mail saying that
her GC was approved by mistake and it is being revoked!

Hello guys!
I wanted to volunteer a thought that had been in my head, so I am basically thinking out loud here for a bit, just throwing this out there for your guidance, tell me if you think this is too aggressive, or even premature?
I think we need another rally before the end of the year. There are 2 reasons:
1- Presidential campaigns: After this Fall, presidential campaigns will be in full swing, and thus commanding all the attention of Congress, the media and the American public.
2- Memory: People's memories are short. Now that we have the attention of the media and Capitol Hill, wouldn't it make sense that this is the time to redouble our efforts and push harder? If we wait, the iron might just cool off.
Having said that, and as we know, a rally means a lot of money, a lot of work, a lot of dedication to organize. Yet, no one said our struggle was easy, and other people and groups who have gone through tough struggles have had to go through extraordinary lengths to achieve their goals.
So, if we were to hypothetically hold a second rally this Fall, we could go for the "low-hanging fruit", i.e. we can hold the rally where the most of us live, such as Silicon Valley (and we know those folks really come through), we can plan to reach attendance to this event in the tens of thousands. I know we might not have enough time, and the people who worked so hard on the DC rally are probably exhausted. But, what if we just focus on an area where there are a LOT of us, and do a "no-frills" rally? Just get the police permits and show up. Our numbers will do the rest.

I think many of us go through these kind of tragedy. One of my friends got laid off last month and his employer did not give him the letter to file I-485. Now he is back to the line where he was way back in 2000. He has to start his whole immigration process all over again. This guy lost job twice just before he could adjust his status. He is in USA from over 10 years now and he holds nothing but a PD of 2002. There is nothing in US Immigration Law to protect folks like him. What a shame to the US Immigration system.
This may happen to many of us, not only on the job front, anywhere down the line, untill we get our Green Card. For example, what if USCIS reject our application at the end moment, or else what if USCIS deny our I-485 for a reason beyond our control; there are tons of reasons, our life is shaky until we get our green cards.
Would that be nice if we ask something to protect us just like AC 21? For several folks, even to get to the stage of AC21 is a big milestone. Is it not the time to ask congress to protect all H1-B holders who play by rules and who are here over 10 years, with something similar to AC21? When they can consider giving green cards for those undocumented who are here since only 2005, what we legals ask for; besides just play by the rules and stand in the line and leave everything at the mercy of the adjudicator?
There should be some protection for those who come under these unforeseen clutches of law, besides fighting for mere retrogression.

I have another employer which I am working now with.
How likely is to get an approval (or an rfe for paystubs?) before 180 days.

Called Rep. Lamar Smiths office, They took down the bill numbers and my message. They did mentioned that the bill is in the Jud committee and I need to call the Jud Committee chair, but I did mention that Rep. Lamar Smith's support would be key to solving the backlog issue in the EB GC process.
