In USA, political system works on coalition. If you help others then they help you in time of need.
How many of us have helped others without thinking "what is in it for me". I have seen people who are stuck in FBI Name Check and they dont help people with F1, H1, GC issue, so when one gets what (s)he wnats, everyone else is ignored.
If we want to stay in USA, then we have to leave our sofas and help other ogranizations in their cause. you don't have to agree with everything they say, but some things can always be agreed upon.
This is what I learnt from Congressman Keith Ellison.
So be part of political process at every level..city, state, etc..
Then when time comes and you need help, you will have people behind it..

never worked for "employer x" after H1 transfer, perhaps you are out of status. What is your lawyer saying? You never transferred H1 back to emplyer#2?

And the worst thing is they approve it from the date tey approve it to 1 year after..My EAD which was expiring on 2th Sep'2008 was approved until Jun 20th 2009. Basically I got a 9 months extension...What a plan...

In 2001 when I travelled to India, I paid 1200 to fly NWA. I paid 1000$ in 2008 on Asiana. Very good service. Although airline costs have increased, price of tickets havent increased proportionally.

Thumb-up for the DC Rally! I think our efforts will be long-term. We got to get the idea across to as many people as possible. Rally is powerful, but we also need to use other types of campaign--big or small to get our voice heard.
One idea my American friend shared with me was to make presentations at retirement centers or community centers/ events. We need to be visible and our contribution to the country made known.

I am not sure why we are focusing so much on the negatives of Plano meeting. There were so many new members for this meeting. I am not sure why nobody is focusing on this positive outcome.
Yes, there was certainly a positive outcome as well. This meeting certainly established some members (Mostly who attended - Most old , some new) as "dedicated ones". Now coming to your question... I would not say it as "negatives".. rather I would say it as "self correction"... If I have some flaws or my organization has some flaws, it is my duty to recognize it and try to correct it. If these self correction methods applied to very early stage of organization, it would be good for everybody in a long run. No organization can run without accumulative efforts from everybody. Yes, in Dallas we have many dedicated members but when you see some members dedicating time, money, communication and others even not attending the meet forget about contributing efforts then something is definately wrong and you need to accept it and adddress it. I think needhelp and logiclife are doing that here.
One thing everybody need to understand is that we are sitting on a fire and with getting EAD if we do not want to understand that fact than nobody can save us. Collective efforts bring enthusiasm, oneness and societal brotherhood feelings which pushes more to people for standing up for the cause. Now say if we do not address this then what will happen is slowly people dedicating will be disheartening for putting more rigorus efforts which situation definately demands. SORRY BROTHER, I DON'T AGREE WITH YOU AND YOUR WAYS of TRYING TO HURT REPUTATION OF SOME otherwise better AIRLINE.
we have some really bad bad exp with lufthansa last year. same way my coworker had a horror story with northwest airlines. There were some IV thread of bad treatment of indians by airfrance at paris. Things can go bad. It shouldn't, but it does. Doesn't mean you not only make a bad image forever in your mind and try to spread that on others. With your theory, all airlines are bad and no one should fly ever.
While I never flew with airindia so far (planning to fly airindia next year), my parents did and they had a wonderful experience, food and courtsey.
I have full sympathy with your aged in laws. They do deserve a better service, esp with a baby travelling with them. I pray that now onwards, they never face such troubles. Smile and be positive.

It is with great shame I bring out this piece to you about how Air India is using the "India" tag by cheating its innocent citizens and show its ugly real face. I have never seen anything so unprofessional and have no hesitation to say they are the worst airline in the world.
Passengers:
Father-in-Law (FIL) and Mother-in-Law with baby
My in-laws were returning to India via Air India on September 24th from EWR (Newark, NJ) airport after brief US visit.
Ticketing Experience:
We started the whole process 1 month earlier and contacted Air India (1800 223 7776) about the booking. First we got an answer saying that the class we booked in is full and we have to pay another 40$ per person for another segment. For that we had to call another AI booking# and after 40 mins on the call could reach an agent. We
got new confirmation #s and when asked for the basinet seat was told they could not see the seats and have a special request sent and asked me to call back in 3 days to confirm. We called like 5-6 times and everytime were told they cannot view the seats and when asked to see for seats in another segment or another date, we were told to
re-book again and then ask for seats. How on earth could an airline not see available seats in its aircraft.They have taken customer service to new digraceful level.I roped in my brother in law to go to AI office in Newark and try with an agent directly. Even after
going for 2-3 times directly to the AI office, my BIL failed to secure us the seats. After all the tries we were ultimately told to go to the Airport sooner on the travel date so we can get a basinet seat.
Journey Day:
On the date of the travel in-laws reached at 2:00 PM at the airport in hopes that they will get a basinet seat. The agent gave them a hard time and we had to go back n forth 2-3 times for getting the seats confirmed and have in-laws and baby seated together. I think the whole ticketing at the aiport is being handled by a third party who
are doing a horrible job. My FIL in the meanwhile buys a gift at the custom notified shops at EWR.The flight which was to depart at 6: 20 PM was ready for take off when all of a sudden the pilot says there is a technical problem (God knows what would have happened had the flight taken off). The flight returns to the gate and the passengers are told to wait until they fix the problem. They wait for 2 hours and are asked to then wait in the
boarding area until they really look into the technical problem. (In the meanwhile we hear on Indian TV channels that there is a Pilot strike going on in AI regarding Pilot pay package which adds to our tension). The Air India (airindia.com) website is for show off only with few flight images and had no flight status. We immediately call the AI office in Newark who have no-clue what is going on. When I asked the problem they said it is confidential and cannot be told:(. Eventually all the passengers are told that the flight has been
cancelled for the day and should return the next day and all the checked in baggage will be returned. My poor in-laws with baby had to return back and reached home at 3:00 AM in the morning.
The next day:
The next day the whole scene repeats again and we had to deal with the irritable AI ticket agents who say they are missing something at their whim. We were able to get a basinet seat this time also and happy we were all set for the 6:20 PM flight. This time we gave my FIL a pre-paid cell phone. The same thing repeats again. This time they wait in the boarding area and are told that the pilots have gone to repair the earlier (Sep 24) flight which had an issue. They wait patiently until 10:15 PM. We were all tensed here
and were expecting the flight to be cancelled this day also. No body from AI was available this day to pick-up and explain what is happening. The call re-directs to India who have no idea about the flight status in US. My FIL eventually calls at 10:30 PM and said that they will be boarding soon.
Frankfurt stop:
The flight has a stop at Franfurt and the passengers were asked to go to another terminal
for boarding the same aircraft. They had to go through the security check again and to my FIL's horror, the gift he bought at EWR duty free shop was not allowed and removed. When he showed the receipt they said that the gift has been bought in
US and cannot be allawed into the aircraft. :(Air India where are you and what a Maharaja experience.
Worst website ever:
In the mean while we keep checking the AI web site which I think is one of the worst web sites I have ever been to. I think that this contract is also being awarded to some third party with crores of tax payer money. we were looking for schedules of flight which departed on Sep 25 from Newark airport and here it shows th schedule of the 24th
flight.
Customer Service in Mumbai:
We tried to track the flight (if flightreached Mumbai) by calling AI desk in Mumbai. They had no idea and after repeated calls could reach an agent who made some research and
told that the flight has reached Mumbai and gave further schedule of the flight.
Flight reaches Hyderabad:
The flight reached Hyderabad after change of flight in Mumbai.
Luggage:
Some of the luggage was missing. To our horror the bags we got had stuff from some other people's bags. Please leave the luggage Air India.
Summary:
What a mess Air India. You have taken advantage of the "always yielding" Indians who prefer you for a home experience. Please remove the word "India" nd the "Maharaja" symbol as you are no longer fit for that.

Its always better to use overnight Fedex.
I have had bad experiences with UPS in the past.
I don't recomened to wait until Aug 15th...since there may be postal delays/package missings, etc.,...very recently happend to me with UPS overnight (aqfter 3days of investigation - tjhey simply said package is missing)....so guys consider some factor of safety time...i would suggest don't want more than Aug 10th.....

I work for company A on H1 B. Got offer from company B and I accepted it set all the papers for H1 B transfer. Company B filed for LCA and recvd. it. They are ready to file for H1 B transfer. Gave notice to company A and they countered the offer and I want to stay.
Now my concern is as Company B has filed for LCA but H1 transfer is not filed yet. If I decline the offer will it effect my current H1 B?

Here is what Attorney Mathew Oh thinks about provisions for STEM.
Section 406. Visas for Individuals with Advanced Degrees: Section 406 exempts from the numerical cap on employment-based visas aliens with advanced degrees in science, technology, engineering, or math, and has worked in a related field in the U.S. during the 3 year period preceding their application for adjustment of status.
[Matthew Oh Comment: This benefit appears to apply not only to the U.S. earned advanced degree holders but also to those advanced degree holders who earned the degrees in the foreign countries as well.]
It also exempts immediate relatives of aliens who are admitted as employment-based immigrants from the numerical limitations of 203(b).
[Matthew Oh Comment: Exemption from the numerical limitation of spouses and children of EB immigrants and exemption from the numberical limitation of advanced degree holders in science, technology, engineering and mathematics with 3-year employment in the U.S. would practically make a substantially large addtitional numbers available to the total EB immigration numbers beyond the total cap of 290,000.]
Finally, it increases the available visas numbers for H-1B nonimmigrants and provides an exemption from the numerical limitation aliens who have earned advanced degrees in science, technology, engineering, or math.

I want to thank this european who got his greencard 2 weeks back but still attended the rally. There may be more heroes like this. I was in a group of people when we spoke to him, didnt catch his name as i was encouraging bypassers to honk their cars to support our cause.
He is over 6 foot, in immigration voice t-shirt and blue jeans. He is swedish...Please share his name if anybody knows....
I was the guy from Sweden. I agree with the Russian student.
The reason I was there was because my green card process was a painful and stressful experience for 5 years. And I was still one of the lucky ones! I don't want to put anyone through the same agony, not even my worst enemy. I really feel for the people still stuck in the mess.
I talked to a Polish guy who had been here 9 years fully legally and could not leave. He had not seen his family in 9 years and did not want to risk going back just in case they would not approve his H1B in his home country. They are very strict there it seems, because none of his family members or friends could not even get a tourist nor visit visa to see his graduation. Shocking!
I was glad I showed up at the rally just to hear all the peoples' stories.
Most people who did not show up probably think they are ok after applying the i485. They will join IV rallies, when they realize how wrong they are. People have applied for i485s years ago and still don't have a green card...

There was another russian gentleman who got his green card 6 months back and is a student now. Yet, he had driven 3 hours from NJ just to cheer us. He mentioned that he understands how painful this process is and wanted to encourage us by attending.
I met an Indian who got his green card in year2003. Still he attended to give moral support to IV. Hats off to all those guys who made it to the rally even after getting there GC's. Hopefully those people who are still stuck in the GC mess realize the importance to actively participate in the events organized by IV.

The reason I was there was because my green card process was a painful and stressful experience for 5 years. And I was still one of the lucky ones! I don't want to put anyone through the same agony, not even my worst enemy. I really feel for the people still stuck in the mess.
I talked to a Polish guy who had been here 9 years fully legally and could not leave. He had not seen his family in 9 years and did not want to risk going back just in case they would not approve his H1B in his home country. They are very strict there it seems, because none of his family members or friends could not even get a tourist nor visit visa to see his graduation. Shocking!
I was glad I showed up at the rally just to hear all the peoples' stories.
Most people who did not show up probably think they are ok after applying the i485. They will join IV rallies, when they realize how wrong they are. People have applied for i485s years ago and still don't have a green card...

There was another russian gentleman who got his green card 6 months back and is a student now. Yet, he had driven 3 hours from NJ just to cheer us. He mentioned that he understands how painful this process is and wanted to encourage us by attending.
I met an Indian who got his green card in year2003. Still he attended to give moral support to IV. Hats off to all those guys who made it to the rally even after getting there GC's. Hopefully those people who are still stuck in the GC mess realize the importance to actively participate in the events organized by IV.

Do not give misleading information. When you do the transfer the original visa is not cancelled. In fact you can have more than one H1B at the same time and work for them. For example two part time jobs for different employers. But the only catch you should always work only for the sponsoring company. If you decide not to join them at all, you can do so. But you have to maintain the status thru your current employement or another employer.

Dude, I have to tell you the same, do not give misleading information. you need to have a full time position for H1B. there is a minimum number of hours per week that you specify on your Labor condition. 2 part time doesn't cut it. As I have mentioned before, you may have multiple sponsors but one of the sponsors should be primary and you work full time with him or the minimum number of hours per week as per LC. other one could be part time. But there needs to be 2 seperate independent I-129's filed by both employers for you to do this.

Immediate attention of Congress/Senate to increase GC visa numbers for Retrogressed/ALL countries needs to be set first priority in Lame Duck or new congress sessions...and we/IV have to work towords that..
CIR is a good vehicle to piggyback on, and I realize it is better to bank on a bill that is already introduced.
However it seems like asking for increase in visa numbers, or just the ability to file I-485....What does this mean - automatically it would require increase in visa numbers, and reduction in name check times, for example.
Dependents can wait to work if it is only a year. We dont need to keep renewing visas. We are not stuck to one employer.

As the bill stands today, you are correct and unfortunately that will do more harm than any help. so we all should try to eliminate this potential trouble

assuming 290000 seats passed of which 35 % is EB3 .. would make it 101500 seats.. if country restriction is 10% then it would mean just 10150.. is my understanding correct. . ?
