I agree 100 %. But even if the officer wants to know about out I 140, it wud be just a 1 min process for them as they can check if a recipt was generated based on the names.

Anyways since there are so many hundreds of people who filed I 140 in the recent days, I believe some alternative from USCIS wud show up in the next few days .......
Agree.. Any idea if Service Centers will entertain queries for receipt number in person? I'm not that far from TX service center in Dallas. Might just drive up there to find out sometime midweek if there is no guidance from USCIS by then!

I am in EB2 ADP with PD Feb'09. No cheating there ! :)
I understand that if a lot of EB3 guys, who have been waiting for years, start porting to EB2, they will end up in the queue before me :(. And with that knowledge, I will still support EB3-EB2 porting.
EB3 guys, porting is your best option. I hear a lot of EB2 asking you to go get a new job where they are willing to
a. Hire you with your H1B status,
b. Agree to file your GC, and
c. Agree to do it in EB2 category. (Think about the min wage they have to give and prove etc.)
It is way easier said than done in the current economy. But if you find one, go for it. That is a way of respite for you folks. For others, try porting to EB2 with your current company.
There have been cases where EB3 was filed when the candidate was eligible for EB2 and there have been cases other way round too. But talking about none of them helps your cause. Not sure I follow you. How are we getting 50K spill over visas?
How we are getting 50k is like this.
1) EB1 Over Flow (50% of EB1 was unused last year) 46k/2= 23k
2) EB2 Over Flow , this number is still fuzzy. But lets say around 10k.
3) EB2 India has quota of 3500.
So approx 40k.

I didn't attended because recently I had a new boss and he was monitoring my daily schedule and being in H1b and coming so close to filing I-485, I was just waiting for my EAD or I-485 cheques to get encashed. On 21st Sep, they got encashed. Now I am bold enough to take a day or two as vacation and attend rally if organized in eastern part.
I did paid 50% travel cost to one of our member from CA.
Sorry for not attending this time, will do it next time.

I was 100% determined in the beginning to attend the rally, but could not for the following reasons.
1> I was in Dallas and family in SoCal for last 9 months(from Dec 2006 to be precise). I used to meet my family every other weekend. Was trying very hard to find a project in Socal, and finally I got one where joining date was Spet 13th. I could not dare to ask for leave in the very first week. To tell you the truth it took so long b'cos of H1 status, everybody wants me to transfer my H1 or they are looking only for GC/EAD holders. Hoping to get EAD soon.
2> My husband was planning to attend but somewhere in Aug last week we got FP notices and date is Sept 18th. The FP letter clearly mentioned that postponing might cause delays so we decided that he also has to drop the idea.
Of course we contributed towards the rally.
I am very proud to be part of such excellent grass root organization and now since I am in Irvine I can be active in Socal chapter.
Also we are eager to join in the next rally and have total faith in IV leadership

Above excuses seem perfectly genuine to me. I had a court hearing myself. I applaud your friend's sincerity in attending the rally and I also applaud everyone who attended for that matter. But, IMHO, you were too quick to judge/question other people's genuineness.

Republicans chose VP just to give them the edge. It doesn't matter to them if the VP-nominee is qualified or not or can be President in a heartbeat or not.
Selection of Cheney as VP lead to the outpour of financial support from oil and construction industries. More money, more power, more ads. They are playing dirty politics. So dirty.
Obama atleast has fundamental values that makes him a leader. Young as he is, inexperienced as he is, means he is not polluted by this dirty politics.
I'm really, really scared for all of us immigrants if McCain wins this election. When a Republican president is under control of the elites, that creates terror from within.
Maybe in the future when he is president, an i-485 denial notice for a person with no underlying status will be delivered personally by ICE officer, put a handcuff on the person, and straight to detention until the next flight back home. That will be the situation if we get a President under the control of few elites, extreme anti-immigrant, powerful Republicans.
McCain already backed-out from his CIR stance. He said categorically that if the same CIR, which he co-sponsored and voted YES, is put on vote today, he will vote "NO".

There is no minimum number of weekly hours for an H1B petition. There are some H1B workers who hold several part-time positions. I am not sure whether it is my HR to be blamed or my corporate law firm TheChugh who has been handling my case, no one has bothered to convey my PERM status or even my case #. I feel frustrated when my HR doesn't respond about the status.
I understand that they must by flooded with application preparation but setting up a link for me to check the status shouldn't be very difficult.
I really hope that my PERM gets approved before 31st July so that I can file I-140 and I-485 concurrently.
Anyone else has experience to share about TheChugh law firm?

Well, one could argue that North Americans have access to the TN visa, which is kind of easier to apply. Similarly, the E visa for Australians as far as I know doesn't allow a dual intent;therefore the H visa still has an advantage over the Australian one.

I wonder why nobody takes up the cause for H4 visa holders who are mostly women and who becomes completely dependant on their husbands once they enter this country .With retrogression and the endless wait for GC it means losing all the skill sets that you have and all the opportunites that come along just because you donot have a EAD card. Worst of all nobody who speaks so much about womens emancipation seems to care.

Ok. Visa bulletin for December gets published. We are all shocked or surprised by the cut off dates. So, we decide to bash USCIS, run all possible permutations on visa numbers (how many different ways are we going to continue analyzing 140,000 visas), some have even proposed fasting and there are some who are threatening to move to Canada or India (I am not sure who is stopping them).
Let us analyze all the proposed solutions and see if they will really get us anywhere:
1. Bash USCIS: I am not sure if anyone at USCIS or the administration would care. You can stand at the top of Washington Monument and scream and not a single soul will care.
2. Analysis/Paralysis of available visa numbers and the possible movements: USCIS, the department that has access to all the required data is struggling to forecast visa availability, but, I see my friends here with very limited access to data trying to forecast Visa movement. I can bet, even with all the smart PHD�s here that we will not be able to forecast visa availability even, if we built the most complex model and continue to have limited access to data. So, this is just an exercise in futility.
3. Fasting in front of Governor�s office: Great idea! We can work off all the excess weight that we may have put on that we have gained due to over eating (one of the symptoms of stress or depression). I think we are choosing the wrong time of the year to do this. It is cold outside and I am not sure if anyone would even stop by the poor souls to pour us a hot cup of coffee. However, we may gain some publicity. Better than idea 1 and 2.
4. Moving to Canada or India: Please do and USCIS will be glad that they have one less case file to deal with and Numbers USA or Lou Dobbs will pay for the ticket.
Unless we stop these frivolous discussions over pathetic suggestions to fix the problem we will continue ignoring real solutions.
We need to think and execute with a sound long term strategy (12-18 months). Let us not try to eat the elephant in one bite. Let us fix this problem with small, manageable and doable steps.
I hope I do not offend anyone. I think it is time to be serious about the road we take from here.

I was thinking about PMI, CISA and MBA right from the time I landed in US in 1999. Then I realized that I need to get an GC to make use of those. Then I started to look for a stable company where I can start my GC process. It took three years toll till then. I joined a good ameican company as a perm employee. They did not file my GC as they promised and I had to quit to join another company for the heck of my GC and for my (my wife with CPA / CA is on H4 for 5th year now) dream career. I had to go many step back in technology with the new company but I sucessfully managed to file my GC.
Then what? When I finished studying my PMI, all the retrogression story started. Then I had to ask questions my self.
1. With PMI certification in 2004, if I am doing a Sr. Software engineer, will it not raise questions down the line in my career interviews. May be yes or no, but I do not have answers.
2. With PMI Cert in 2004, if I can get my GC in 2005, I am pretty sure I could manage any questions throws at me, but not in 2008 or 2010. So I dropped the idea on PMI / CISA/ GMAT until I have 50% certanity of when I will be getting my GC in hand.
3. The worst will be starting an MBA with good univeristy and competing it in next two years with zero hope of getting GC then. What would you do if you are not even closer to file your 485 when you have MBA degree in hand. You will have career in your home country with this MBA for sure, but who will pay your debts here. It is like shooting yourself on your foot with golden gun. Atleast you will be satsifed it is golden gun, but the end result is hurting yourselves.
4. So what is the option? Never give up. There are always difficult times for everyone. What we are facing is nothing. There are people who are graduating at the age of 70 in US. I have seen a lady at the age of 70 graduating with MAB from Harvard. I thought she did it for fun, but in an interview she said she wants to pursue her career in marketing field. This is an eye opener for me. So prepare yourself with TOEFL and GMAT. These scores are valid for 5 years. Join from volunteer organizations and develop your leadership skills. Reco letters from these orgs will have great impact when you apply for MBA infuture. Most of all it is right way to live a peaceful life atleast if you do not go the MBA route, you will develop the skills needed for your life.

We should try something like applying for 485 without priority date but even the cantwell cornyn amendment does not have this provision
We should lobby for only this thing at this time ..
This will resolve most of our problems...

I filed I-140/I-485 April 22 and received receipt notices. No appointment letter for finger printing yet and no LUDs. Texas currently processing date is April 28 for EAD. Sould I be worried?

There are many here (on IV forums) who question if Lobbying and Grassroots efforts really works. It they didn't, we wouldn't be here!
Read the following article on early Indian Immigrants and their miserable conditions before 1946. How they overcame the racist/xenophobic labor groups opposition through lobbying and grassroots efforts and became citizens.
