Can i apply for 485 and not apply for EAD because i am not sure when i can get married.Is is possible to do so and apply for EAD after getting married.

If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.


If I 140 is rejected then the EAD,AP and I 485 are rejected as well. If you have used EAD then ur H4 is no longer valid ! You will have to go out of the country and get H4 stamped.
So the recommendation is to keep H status alive till you get Greencard

Could someone please detail the process of adding your wife to the existing 485 application. I am sure there are many folks like myself who had applied for 485 before they got married and now have to add their spouses whenever the dates become current
Do you have to get a lawyer to get the process done or can you do it yourself

My Husband's I 140 got approved and his lawyer included my name as well in the I 140 application.

Can some one plss help me by letting me know if I can change to F1 for my further studies inspite of my name being included in the I 140 application

Plss let me know at the earliest possible as I need to apply for change of status before may....!!!!!

I have filed two different I-140s for EB2-NIW (NSC, Nov 06)) and EB1-EA (TSC, march07). Both are pending at the moment. I wish to apply for I-485 now as the visa numbers are current in both categories.
I will appreciate if some one could advise if I can go ahead with the filing with pending I-140s. Also in that case can I file a single I-485 now and just ask it to be linked to whichever I-140 is approved first. will this work?
In this case whcih 140 number should I mention in my application and whcih center should I send the application to?

I am on 6th year of H1B. My visa expires in Sep 2009. My mom is likely to appear for B1 by Oct 2009. My 7th H1B extension has been approved, but I have not stamped the visa

Question:
Do I need to have a stamped visa in my passport for my mom to get a B1? Would US embassy accept copy of I-797 of H1B approval notice?

from my personal experience and from others, you can't get to talk to an Immigration Officer by calling the 1-800 number. you need to get an Info pass appointment and that way you can talk to an IO.

It is clearly stated in the I-485 instructions that parents should sign for children below 14 years of age. Those 14 and above should sign for themselves.

Do we need to sign the I-485 docs on behalf of minors? My daughter is 9 years old and she has signed her papers all by herself. When I asked my attorney, one time she said I need to sign and finally she sent the docs with her signature only.
