Here is an update on Visa recapture from Aman:
"I know some people ask for achievements of Immigration Voice and comment, sometimes ridicule, that Immigration Voice has not been able to get even one provision in last one year. There are many other organizations working on behalf of various groups. If no immigration provision has passed in more than last one year, does it mean that all those organizations are also ineffective? We all know that this is a world of instant gratification but please understand that there are groups who go to DC to get their issues addressed and they wait for 2, 3 -5 years before anybody would start listening to their issues. You see, just to explain using an analogy, Microsoft is working to get H-1b numbers increased long before Immigration Voice started. If Microsoft has not been able to get Congress to increase H-1B numbers, does it mean that Microsoft is no longer an effective corporation? Likewise, Immigration Voice has made significant progress but due to the political climate and statistical discussion about the undocumented, which of’course is different but an important issue, our provisions are clubbed in the comprehensive bill. If it would have been any other year when Congress was not considering the issue of undocumented or comprehensive immigration reform, advocacy effort of Immigration Voice would have definitely translated all our provisions into law six months back.
If you want us to get Visa recapture as interim fix, allow me to share with you that as it stands today, it will not happen outside of Comprehensive bill. Infact as it stands right now, even H-1B increase will also not happen outside of comprehensive bill. Reason? Most of the groups and companies have stopped pushing for temporary relief because any kind of temporary relief or interim relief chips away support from CIR and the offices of Senate and House Leadership along with other proponents of CIR have made it clear that any immigration relief has to be a part of CIR and not outside of it. Other companies/coalitions have stopped pushing for temporary H-1B increase as they do not want to be in the bad books of committee chairmen and the leadership offices by trying to sneak temporary relief that divides the supporters of CIR. Leadership wants support for CIR and want all sides to wait for CIR. And not doing so and trying to get interim relief before CIR would put them in bad books of Senate and House leadership, which no one wants coz if CIR fails, then after CIR, these offices will not co-operate with any group that tried to take away support from CIR. So it would be counter-productive politically to do things that take away good stuff from CIR. Also, if you think that any effort in the final week could help in anyway, then let me to share with you that most provisions and their language are decided much in advance and last minute efforts almost never yield any result on the Hill."

Take it easy for the time being - IV is looking into what to do next. Use this time to stabilize state chapters , conduct social events so that people can have a nice time.

No need to jump the gun. I didn't ask it at a personal level, in case you didn't understand it! Instead of nitpicking on a single statement, read the whole paragraph! I am a member of a state chapter and keep posting on the Yahoogroups, though it's been a month since anyone else posted there ( and I don't get any replies).
I'm not getting into personal level/ad hominem discussion as it's pointless. I don't need to prove anything to anybody.
Here is the deal, the idea of state chapters is for grass roots organization. We can't reach out to everyone if we don't have remote hubs, it is as simple as that. We recently revived the WA state chapter and I keep sending emails, one or two respond, the rest are silent readers. However they did join the group and we are now 30+ members. Now, we plan to have a conference call and then we are planning to get together within 2 weeks to meet all of these members. No one is forced, but we would send out and invitation to every member. Then we come out with certain agendas and action items that fall within IV goals. Like one of the main things is to meet local law makers within each state for follow up. This is best done at state level. So I understand the part that you care confused is nothing is happening and you just keep writing. I know the feeling but can you get everyone together, can you get to meet them one by one. Trust me, once you get the ball rolling, before you know, you will have a big strong chapter that makes it easier to pass targeted messages and so on. When IV events are held in a national level, information and action items can be distributed to state chapter leaders who can then follow up.
But yes, it is hard work in the beginning to get every one on board, trust me, I am fighting the same battle, but hard work pays off!

i would not recommend either murthy or R khanna i had a lousy exp with R Khanna and a friend of mine with murthy. I love Fragomen (my Co uses them) my last company i used Thomas Fan (based in MD) I like them both.

If an H1 gets layed off, how soon must he leave before he is considered illegal status? And for practical purposes, does it matter (ie, is it ever enforced)? Does having severence extend the period (because you're technically still on payroll)?

I am confused. it is very contradicting.
That's why there is a saying that you should never watch sausages and laws being made.
The Cantwell amendment and Lieberman amendment will fail to pass the vote. It doesnt matter whether its ordered to lie on table or whether its ordered to take a nap on the table or have some lemonade on the table. And it doesnt matter what any of those "Motion to... " means.
Both of those amendments, if debated, will fail. It will take 10 seconds for Bernie Sanders, Ted Kennedy and Dick Durbin to scream on top of their lungs and kill it. And the reason is very simple. There is a massive H1B exemption ON TOP OF 180,000 QUOTA. People who have been so successful this year so far in restricting H1 and employment based GCs are not going to miss that nice little H1 exemption at the bottom of both these amendments. So stop scratching your heads over what the "lying on table" means, because whatever is lying on table is unpassable if it somehow awakes from the table and starts dancing in the well of the senate floor.

I am really concerned. Employers will lobby for increase in H1-B.
Well, at least most of them. If it comes to either H1-B or GC, they will obviously opt for H1-B increase.
So, if in the last minute, only H1-B is increased and not GC (Anything can happen behind closed doors negotiations) we will have more H1-B with the GC dream and suffering like us.
I think our Web fax should categorically state that we support Only GC related provisions in the skill bill. Else, at least, I plan not to sign the petition.
We don’t want to be supporting a cause outside of ours that will eventually indirectly
affect us. It will also affect many starry eyed new H1-Bs chasing their ever elusive GC dream. Haven’t we all had enough.
Does IV has any role in this step?
It would be difficult in the current situation to have a resolution of EB retrogression issue without putting it along with either H1visa (lobbied by industries) or CIR-like (lobbied by pro immigrationists and agreeable to majority of senators). I think this is as good as it could get. The other alternative would be to add clauses or amendments to existing 'guiding laws' of immigration by Congress which is a far cry. Looking at the language and treatment in past 4 or 5 versions of immigration bills since last fall, I have seen that H1 always get clubbed together with EB visa numbers and so it would help to wait and see how this bill evolves thru the legislative processes. Can this bill come under the lobbying prowess of IV to make sure EB specific clauses are not diluted?
BTW, what happens to those holding foreign PhDs or equivalent degree/training in specialized areas (apologies if this question had been answered before)?

I flew from Seattle. Started 4:00PM monday afternoon and reached 7AM tuesday. left 5PM tuesday and reached home at midnight. HAd to take an unpaid vacation.
I had asked IV for sponsorship.
I got sponsored for a non-stop and a very comfortable flight. but it was $700. Although IV was able to collect $700 for me(thanks to abhijit), i felt it was a little too much to be spending on one person. I raised another $150 from friends and $75 from my own pocket and bought 2 cheaper tickets instead(with bad schedules) and got another friend of mine to go with me.
I had a choice : spend $700 of IV money on one comfortable ticket
OR
spend $75 out of pocket and hours of talking to others to contribute and get one more person to go with me and fly a weird schedule..
I'm proud to have made the right choice!

I am not negating anyone's personal decision here but after leaving for 10 yrs in US and still not having a GC makes me wonder why I should go to canada rather I would go to india and live there where we spent our 25 yrs or so and be part of the community etc.

Let us not be too eager to praise IEEE. How many people have been able to get Green Cards without first getting H1B work visas? Most skilled workers need to get to the US on work visas before they can apply for permanent residency. So, cutting H1B visa numbers effectively curtails immigration too. IEEE is anti-immigration plain and simple.

I would love to attend the rally. However my financial condition at this time does not permit me. I could have booked a ticket on my credit card but all my cards are max out!
You want to know why I am in this financial deep hole? Well, I have two sons in college and paying out of state tuition, that is over $17,000 per semester for both of them.
My wife on H4 could not work until now that she has an EAD. It is retrogression that I should blame and I would love to do all in my power to obtain relief or bring the issue to the attention of the American public.
In my own way I have contributed to IV both in cash and in kind. I have told me story in countless media interviews. I only wish I could do more for IV financially but alas I am not able to do that at this time.
I would be in the rally in spirit....only I wish I could attend in person.
We can help! We want to make sure as many people as possible come to the rally. Those in worse financial positions can take advantage of the many generous offers from other members who are willing to sponsor others.

I too had very bad experience with Air India, the aircrafts are in bad shape, very poor customer service. I stopped taking Air India after couple of bad experience. I take Jet Airways now, they are pretty good, friendly hostess and good customer service.
